A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
MAKING FINDINGS AND APPROVING ELIMINATING PUBLIC ACCESS TO A
PORTION OF BAYWALK WITHIN THE MIAMI BAY CLUB PROJECT TO BE
LOCATED AT APPROXIMATELY 601 NORTHEAST 39 STREET, MIAMI, FLORIDA.
WHEREAS, on July 31, 2015, Iris V. Escarra, Esq., on behalf of Miami Bay Trust, LLC, submitted
a request for a special appearance to request permission to eliminate public access to the baywalk
being built as part of the Miami Bay Club project ("Project") to be located at 601 NE 39 Street; and
WHEREAS, this request to eliminate public access to a portion of the baywalk within the Project is
subject to City Commission approval pursuant to Section 3(mm)(iii) of the Charter of the City of Miami,
Florida, as amended ("Charter"); and
WHEREAS, the City Commission has considered the applicant's request and deems it advisable
and in the best interest of the general welfare of the City of Miami ("City") to approve eliminating
public access to a portion of the baywalk within the Project;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as fully set forth in this Section.
Section 2. The City Commission hereby finds that the Project complies with the criteria found in
Section 3(mm)(iii) of the Charter and Article 3, Section 3.11 of the Miami 21 Code, the Zoning
Ordinance of the City, and hereby eliminates public access to a portion of the public baywalk located
within the Project to be located at approximately 601 NE 39 Street, Miami, Florida, legally described in
"Exhibit A ", attached and incorporated.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {1}

Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
