Purpose of Item: A Resolution of the Miami City Commission accepting and authorizing the City Manager to execute covenant(s) to run with the land with owners of property within the Miami Design District Retail Special Area Plan ("SAP") for the installation and maintenance of non-standard street lights, non-standard street identificationsigns, non-standard hardware for traffic signs, non-standard devices for non -signalized pedestrian cross -walks and painting of traffic control hardware and support systems within Miami -Dade County right-of- way along certain portions of NE 2 Avenue adjacent to the SAP.. Background Information: The Miami Design District SAP was adopted by Ordinance No. 13334 on July 26, 2012. The SAP includes non-standard improvements and enhancements within the dedicated public right-of-way. Owners of property within the SAP district have requested permission from the City and County to construct and maintain the non- standard improvements within Miami -Dade County public right-of-way along portions of NE 2 Avenue adjacent to the SAP. The said owners will construct the non-standard improvements, indemnify and hold the City harmless for the non-standard improvements and be responsible for their maintenance by way of covenant(s) to run with the land with the City. Execution of the covenant(s) by the respective property owner(s) is required prior to the City's execution of Interlocal Agreements with Miami -Dade County.
