HomeMy WebLinkAboutR-15-0440City of Miami Legislation Resolution: R-15-0440 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 15-01069 Final Action Date: 10/8/2015 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S ACCEPTANCE AND EXECUTION OF AMENDMENT 1, MODIFYING THE TERMS OF THE 2014-2015 VICTIMS OF CRIME ACT AGREEMENT, ATTACHED AND INCORPORATED, TO COVER ANOTHER FULL FISCAL YEAR, AT THE SAME FUNDING LEVEL AS THE CURRENT YEAR, BY ESTABLISHING A NEW SPECIAL REVENUE PROJECT ENTITLED "2015-2016 VICTIMS OF CRIME ACT GRANT", AND APPROPRIATING FUNDS, FROM THE STATE OF FLORIDA, OFFICE OF THE ATTORNEY GENERAL, IN THE AMOUNT OF $32,467.00 AND THE REQUIRED MATCHING FUNDS BY THE CITY OF MIAMI IN THE AMOUNT OF $8,117.00, IN THE FORM OF IN -KIND SERVICES TO BE PROVIDED BY THE POLICE DEPARTMENT, FORATOTAL PROGRAM COST OF $40,584.00; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ANY AND ALL OTHER NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO IMPLEMENT THE ACCEPTANCE AND ADMINISTRATION OF SAID GRANT. WHEREAS, the Victims of Crime Act ("VOCA") assistance grant program is administered by the State of Florida, Office of the Attorney General ("OAG") and offers funding for use in responding to the emotional and physical needs of crime victims, assisting victims in stabilizing their lives after their victimization, helping victims to understand and participate in the criminal justice system, and providing victims with a measure of safety and security; and WHEREAS, the City of Miami ("City") submitted a grant application to the OAG to fund services provided by the City of Miami Police Department ("MPD") to crime victims; and WHEREAS, pursuant to Resolution Number 14-0395, adopted on October 9, 2014, the City entered into an agreement entitled 2014-2015 Victims Of Crime Act Agreement accepting a grant award in the amount of $32,467.00 and required matching funds by the City in the amount of $8,117.00, in the form of in -kind services, to be provided by the MPD, for a total program cost of $40,584.00; and WHEREAS, the City received a letter advising that the OAG is in the process of seeking additional funding for the program, but that the funding will not be addressed until the 2016 Florida Legislative session; and WHEREAS, in an effort to ensure that current VOCA subgrantees do not experience a gap in funding for the 2015-2016 grant cycle, the OAG has proposed Amendment 1 which modifies the term of the 2014-2015 Victims Of Crime Act Agreement and extends funding for another full fiscal year at the same funding level as the current year; and WHEREAS, the extension of funding was contingent on the City agreeing to ratify Amendment 1, thereby agreeing to modify the Time of Performance, Amount of Funds, and Method of Payment no City of Miami Page 1 of 3 File Id: 15-01069 (Version: 1) Printed On: 3/27/2018 File Number: 15-01069 Enactment Number: R-15-0440 later than September 21, 2015; and WHEREAS, funds from this grant amendment will be used for the continued funding of a Victims Advocate position for the duration of one (1) year and the City will provide the required 20% program match, in an amount not to exceed $8,117.00, in the form of in -kind services by personnel of MPD's Victims Advocate Program; and WHEREAS, the City Manager executed Amendment 1, to accept said grant and to establish a new special revenue project entitled: 2015-2016 Victims Of Crime Act Grant, for the appropriation of said funds, subject to the City Commission's ratification; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager's acceptance and execution of Amendment 1 to the 2014-2015 Victims of Crime Act Agreement, attached and incorporated, to cover another full fiscal year at the same funding level as the current year, by establishing a new Special Revenue Project entitled "2015-2016 Victims of Crime Act Grant", and appropriating funds as described below, is ratified, approved and confirmed. Section 3. The following new Special Revenue Project is established and resources are appropriated as described below: FUND TITLE: 2015-2016 VOCA Grant RESOURCES: State of Florida, OAG $32,467.00 City of Miami's Department of Police in -kind services $8,117.00 APPROPRIATIONS: Victims Advocate Program $40,584.00 Section 4. The City Manager is further authorized {1} to execute any necessary documents, in a form acceptable to the City Attorney, to implement acceptance and administration of said grant. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: City of Miami Page 2 of 3 File Id: 15-01069 (Version: 1) Printed On: 3/27/2018 File Number: 15-01069 Enactment Number: R-15-0440 {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} This resolution shall become effective as specified herein unless vetoed by the Mayor within ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
