HomeMy WebLinkAboutPre-LegislationCity of Miami Legislation Resolution: R-15-0027 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14-01321 Final Action Date: 1/22/2015 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING AN AMENDMENT TO THE AUTHORIZED EXPENDITURE LIMITS OF FIFTEEN (15) JOB ORDER CONTRACTS FOR MAINTENANCE AND CONSTRUCTION SERVICES CITYWIDE ON AN AS -NEEDED BASIS FOR CAPITAL IMPROVEMENT PROJECTS, INCREASING THE ANNUAL MAXIMUM CAPACITIES OF $2,000,000.00 FOR HORIZONTAL RIGHT-OF-WAY CONSTRUCTION, AND $2,500,000.00 FOR VERTICAL BUILDING CONSTRUCTION, TO THE NOT TO EXCEED AMOUNTS OF $4,000,000.00 AND $5,000,000.00 RESPECTIVELY; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT NO.1 TO THE AGREEMENTS WITH EACH CONTRACTOR, IN SUBSTANTIALLY THE ATTACHED FORM, FOR SAID PURPOSES; ALLOCATING FUNDS FROM THE VARIOUS CAPITAL IMPROVEMENT PROJECTS AND DEPARTMENTAL BUDGETS, SUBJECT TO BUDGETARY APPROVAL AT THE TIME OF NEED. WHEREAS, pursuant to Invitation to Bid ("ITB") No. 11-12-017, the City of Miami ("City") executed fifteen (15) Job Order contracts with the annual maximum capacities of $2,000,000.00 for horizontal right-of-way construction and $2,500,000.00 for vertical building construction; and WHEREAS, the original expenditure limits per contract have diminished by varied but significant amounts, based on the volume of work and the complexity of the projects assigned to each firm; and WHEREAS, the current remaining contract balances are not sufficient to cover the construction costs anticipated for newly approved projects; and WHEREAS, it is now necessary to enter into Amendment No. 1 with each horizontal contractor, thereby increasing the contract values by $2,000,000.00, to a final not to exceed amount of $4,000,000.00, and with each vertical contractor, thereby increasing the contract values by $2,500,000.00, to a final not to exceed amount of $5,000,000.00; and WHEREAS, funds are to be allocated from the appropriate Capital Improvement Projects, on an as -needed basis; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. R-15-0027 ITB No. 11-12-017 is approved, with each horizontal contractor authorized a final not to exceed amount of $4,000,000.00 annually, and with each vertical contractor authorized a final not to exceed amount of $5,000,000.00 annually, with funds for said increase allocated from the appropriate Capital Improvement Projects, on an as -needed basis. Section 3. The City Manager is authorized{1} to execute Amendment No. 1 to the contracts, in substantially the attached form, with each contractor, for said purposes. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. City of Miami Page 2 of 2 File Id: 14-01321 (version: 1) Printed On: 9/28/2015 City of Miami Legislation Resolution: R-13-0089 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov,com File Number: 12-01444 Final Action Date: 3/14/2013 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE FIFTEEN (15) JOB ORDER CONTRACTS ("JOC"), IN SUBSTANTIALLY THE ATTACHED FORM, TO PROVIDE MAINTENANCE AND CONSTRUCTION SERVICES CITYWIDE, ON AN AS -NEEDED BASIS, FOR CAPITAL PROJECTS; ALLOCATING FUNDS FROM VARIOUS CAPITAL IMPROVEMENT PROJECTS AND DEPARTMENTAL BUDGETS, SUBJECT TO BUDGETARY APPROVAL AT THE TIME OF NEED; FURTHER AUTHORIZING THE CITY MANAGER TO ADD OR REPLACE JOC CONTRACTORS ON AN AS -NEEDED BASIS. WHEREAS, the Capital Improvements Program ("CIP") identified a need to continue the implementation of a Job Order Contracting ("JOC") system to achieve the timely and cost effective delivery of maintenance and construction services for capital projects; and WHEREAS, CIP issued Invitation to Bid No. 11-12-017 on April 10, 2012, soliciting JOC contracts for horizontal (right-of-way) and vertical (building) construction, and thirty-three (33) bids were received on May 11, 2012; and WHEREAS, the JOC contracts will have an initial term of two (2) years with the option to renew for two (2) additional one (1) year periods; and WHEREAS, all JOC contracts provide a firm fixed price and a multiplier for an indefinite quantity of individual construction projects upon which assignments are made to selected contractors based on quantities derived from completed construction drawings; and WHEREAS, the City Manager acd CIP recommend that the fifteen (15) lowest responsive and responsible bidders identified in "Exhibit A", attached and incorporated, be awarded contracts, in substantially the attached form, for said purposes in the annual maximum capacities of $2,000,000 for horizontal construction and $2,500,000 for vertical construction; and WHEREAS, this Resolution furthers authorizes the City Manager to add or replace JOC contractors on an as -needed basis; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1.
