HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 15-01090 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BYA FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, PURSUANT TO SECTION 18-92 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF A SOLE SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES; ACCEPTING THE EXECUTED SOFTWARE AGREEMENT AND ADDENDUM WITH OPENGOV, INC., THE SOLE SOURCE PROVIDER OF A PROPRIETARY WEB -BASED PLATFORM THAT OFFERS FINANCIAL TRANSPARENCY TO LOCAL AND STATE GOVERNMENTS, SUBJECT TO THE AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY NECESSARY AMENDMENTS, RENEWALS, AND MODIFICATIONS, IN A FORM ACCEPTABLE TO THE CI T YATTORNEY, FOR SAID PURPOSE. WHEREAS, the City of Miami ("City") is committed to offering its citizens full and open transparency as it relates to the City's financial information; and WHEREAS, OpenGov, Inc. ("OpenGov") offers proprietary financial transparency web -based services through a website which they both host and maintain; and WHEREAS, market research conducted resulted in the determination that OpenGov has the unique functionalities that meet the City's needs. This includes displaying the City's revenues and expenditures using numerous charts and graphs, in essence making the City's budgeting data readily available to audiences without requiring a deep understanding of civic budgeting practices. In addition to improving transparency, the OpenGov platform will improve administrative efficiency by reducing the amount of time that City employees need to spend researching and compiling requested financial information; and WHEREAS, OpenGov will allow City departments, outside agencies, elected officials, and the public to easily access updated information at any time without needing to make an information request; and WHEREAS, pursuant to Section 18-92 of the City Code of the City of Miami, Florida, as amended ("City Code"), the first year of the OpenGov, Inc. agreement was approved under the authority of the Chief Procurement Officer, as it was less than $25,000.00 and a software agreement and addendum with OpenGov, Inc. were executed. This first year allowed the City sufficient time to determine whether or not the web -based financial transparency platform met the City's needs; and WHEREAS, pursuant to Section 18-92 of the City Code, the Chief Procurement Officer has made a determination in writing finding that the OpenGov is the sole source provider of the proprietary web -based financial transparency platform; and City of Miami Page 1 of 2 File Id: 15-01090 (Version: 1) Printed On: 9/9/2015 File Number: 15-01090 WHEREAS, the findings of the Chief Procurement Officer have been approved and adopted as the findings of the City Manager; and WHEREAS, the City Manager and the Chief Procurement Officer recommend that the requirements for competitive sealed bidding procedures be waived and the procurement of the above web -based financial transparency platform as specified be approved; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, pursuant to Section 18-92 of the City Code, after an advertised public hearing, the City Manager's finding of a sole source, waiving the requirements for competitive sealed bidding procedures and accepting the executed software agreement and addendum with OpenGov, Inc., the sole source provider of a proprietary web -based platform that offers financial transparency to local and state governments, allocating funds from the Office of Management and Budget, Account No. 00001.231000.534000.0000.00000, subject to the availability of funds and budgetary approval at the time of need, is ratified, approved and confirmed; further authorizing the City Manager to negotiate and execute any necessary amendments, renewals, and modifications, in a form acceptable to the City Attorney, for said purpose. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1} APPROVED AS TO FORM AND CORRECTNESS: 1 VICTOf`A MENDE CITY ATTORNEY Footnotes : {1 } This resolution shall become effective as specified herein unless vetoed by the Mayor within ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
