A RESOLUTION OF THE MIAMI CITY COMMISSION, PURSUANT TO SECTIONS
62-521(6)(3) AND (4) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, WAIVING THE TEMPORARY PRIVATE PROPERTY EVENT
LIMITATIONS OF TWO (2) EVENTS PER YEAR, TWO (2) WEEKS EACH, IN
ORDER FOR GILBERT'S BAKERY INC. TO CONTINUE OPERATING ITS
BUSINESS BY PARKING A FOOD TRUCK AT ITS 3340 CORAL WAY, MIAMI,
FLORIDA LOCATION THROUGH DECEMBER 31, 2015, WHILE REPAIRS TO THE
BUILDING CAUSED BYA FIRE THAT OCCURRED IN JULY, 2015 ARE
COMPLETED.
WHEREAS, Gilbert's Bakery Inc. wishes to park a food truck at its store located at 3340 Coral
Way, Miami, Florida, while the locale undergoes repairs due to fire damage that occurred in July,
2015; and
WHEREAS, pursuant to Section 62-521 of the Code of the City of Miami, Florida, as amended
("City Code"), Temporary Events are limited to no more than two (2) events per year per property, for
no longer than two (2) weeks each; and
WHEREAS, pursuant to Sections 62-521(b)(3) and (4) of the City Code, the number and time
limitations can be waived upon affirmative vote of the City Commission; and
WHEREAS, allowing Gilbert's Bakery Inc. to continue to serve its customers by operating a
food truck on the premises while the fire damage is being repaired will benefit the City of Miami's
residents and other local businesses; and
WHEREAS, each temporary event permit will continue to be limited to two (2) weeks in
duration; and
WHEREAS, Gilbert's Bakery Inc. may apply for a temporary event permit for each two (2)
week period through December 31, 2015 and comply with any other regulations as needed by the
City Code for said purpose;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as fully set forth in this Section.
Section 2. Pursuant to Sections 62-521(b)(3) and (4) of the City Code, the temporary private
property event limitations of two (2) events per year, two (2) weeks each, are waived for said period
and said purpose, in order for Gilbert's Bakery Inc. to continue operating its business by parking a

food truck at the 3340 Coral Way, Miami, Florida location through December 31, 2015, while repairs
to the building caused by a fire that occurred in July, 2015 are completed.
Section 3. This Resolution shall become effective immediately upon its adoption and signature
of the Mayor. {1}
Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of the ten (10)
calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission.
