The subject property is one parcel of approximately 104,377 sq.ft or 2.39 ± acres'. The property is an irregular parcel bounded by Bird Road to the north, by the Metro Rail to the east and south, and by S. Douglas Road to the east, less the northwest square portion of approximately 129.02 ft x 121.02 ft. (15,609 ±sq.ft.). BACKGROUND The subject property is located within a changing area that is evolving from D1 (Work Place - District Zone) to T6-12-0 (Urban Core Transect Zone - Open). The site and the surrounding areas to the north, east, and south / southwest are designated Di (Work Place - District Zone); properties to the west are designated D1 (Work Place - District Zone) and T6-12-0 (Urban Core Transect Zone - Open). The properties designated T6-12-0, immediately to the west, recently changed its designation coming from D-1. The Miami Planning, Zoning and Appeals Board, at its meeting on March 5, 2014, following an advertised public hearing, adopted Resolution No. PZAB-R-14-018 by a vote of eight to zero (8-0), item No. 13, recommending approval of the zoning change from D1 (Work Place - District Zone) to T6-12-0 (Urban Core Transect Zone - Open) for real properties at approximately 3734, 3736 and 3750 Bird Road; 3031 Southwest 37th Court; and 3090 Southwest 37th Avenue. These properties located immediately to the west of the subject property influenced the requested change, as expected at the time of that approval. The subject property is proposed for a successional up -zoning form. D-1 to T6- 12-0 following the trend of this changing area. The intensity of the uses adjacent to north bound of South Dixie Highway is being mirrored to the uses adjacent to the south bound of said corridor. The proposed request for a T6-12-0 "Urban Core Transect Zone -Open" is deemed appropriate for the subject property given its location along Bird Road which is a commercial corridor and is located at walkable distance to the Metro Rail Station. Finding: Staff finds the proposed zoning request to be consistent with the goals of the Miami 21 Code, as the request is compatible with the surrounding zoning district to the west and south across South Dixie Highway. The proposed development tentatively named "Pearl at Douglas" will contain ,3- lt.. i+ily units, in two separate 18-story towers and a structured parking garage with 646 l 1 g p es (the "Project"). The Project will require the following approvals: 1. Amend the Property's Future Land Use Map designation from Light Industrial to Restricted Commercial (see, current and proposed maps attached as Exhibit A); 2. Amend the Property's Zoning Map designation and rezone the Property from Di to T6-12 under Miami 21 (see, current and proposed maps attached as Exhibit B); and 3. Site Plan Review. The Property lies adjacent to the Metro Rail on the corner of two major roadways. The Property has been utilized as a car dealership for many years, but due to the evolving nature of the area and its close proximity to the University of Miami, Coral Gables and the Metro Rail line, this area has been revitalized with residential and mixed use development. The subject Property lends itself as a perfect location for a multi -family residential development. I. Amendment to Future Land Use Map The Project is consistent and compatible with the surrounding neighborhood, as the area contains a mix of uses including multi -family developments with similar heights, densities and intensities. The Applicant is requesting an amendment to the Future Land Use Map to change the Property's Future Land Use Map designation from Light Industrial to Restricted Commercial Brickeli World Plaza 500 Brickell Avenue. The Restricted Commercial designation allows a maximum density equivalent to "High Density Multifamily Residential", which is 150 dwelling units per acre. The Project's proximity to other residential uses makes it a logical extension and adequate services and amenities exist in the adjacent area, including easy access to mass transit, to accommodate the needs of potential residents. 2. Rezone Property The Applicant is also requesting a rezoning of the Property from D1 to T6-12 (see current and proposed zoning maps attached as Exhibit B). The Project will be utilizing the Public Benefit Program pursuant to Section 3.14 to allow for bonus height and FLR as follows; the Project will be requesting an increase of height from 12 stories, which is permitted under the T6- 12 district, to 18 stories and a 30 percent increase in FLR. Please note that Section 7.1.2.8(a}(3), of the Miami 21 Zoning Code, authorizes the Planning Department to determine which new Transect Zone is most appropriate when rezoning a D1 property. As further explained in the Zoning Analysis included with these applications, we respectfully submit that a T6-12 zone designation would be the most appropriate due, in large part, to the fact that the area immediately to the west of the Property is zoned T6-12. 3. Site Plan Review Applications will be submitted to the Plans Review Committee and the Urban Design Review Board for the necessary site plan approval and the following waivers: • 10% reduction of required parking; and • Setback reduction along property line facing Metro Rail from 20 feet to 18 feet. We are including a proposed Site Plan for illustrative purposes so as to indicate the residential project which we ultimately intend to develop on the site. Please note that this Site Plan incorporates pedestrian and bicycle connections to the proposed M-path green way currently being planned by Miami -Dade transit for the area under the Metro Rail guideway. Rest Coni Exhibit A Proposed Change in Land Use Designation Proposed Change in Zoning GUNSTER FLORIDA'S LAW FIRM FOR BUSINESS Zoning Analysis 3650 Bird Road The Morgan Group (the "Applicant") is proposing a multi -family residential development named "Pearl at Douglas" (the "Project") on property located at 3650 Bird Road, in the City of Miami, Florida (the "Property"). The Property has historically been used as a car dealership and is currently zoned D 1. In order to redevelop the Project, the Applicant is proposing to rezone the Property from DI to T6-12-0 in order to accommodate the new residential use. This rezoning is consistent and compatible with the recent revitalization of the surrounding area including new residential and commercial development that is taking place around the Property. The Property is surrounded by many different zoning districts including T5-L, NCD-2, DI, T6-12-0, T4-L, and CI, which provide for a unique and diverse area which is transitioning into a mixed use, transit dependent area. The Property is adjacent to the Metro Rail line to the south, which makes it an ideal site for higher density residential development. The proposed T6- 12-0 zoning designation will permit a residential multi -family development complex like the one the Applicant is proposing, which provides residents an opportunity to live in close proximity to mass transit, enabling them to commute via Metro Rail to and from work without the need for a car. This furthers Miami 21's goals of "protection of the environment; conservation of land, energy and natural resources; improved mobility;" and "greater health benefits of a pedestrian environment" (see, Article 2, Section 1 of Miami 21). Rezoning the Property to T6-12-0, will also help further the City's vision for "transit -oriented, pedestrian -friendly" neighborhoods. The Property's rezoning to T6-12-0 will encourage the evolution of a development pattern based on the organizational principles of the Transect. The Transect Zone applicable to this area of the City has development function, intensity and disposition appropriate to the location, and integrates the details of the corresponding public realm. The Project's proposed site plan will address the development provisions within the T6-12-0 transect and create a functional and pedestrian friendly plan that integrates public realm features and plazas along the two major corridors of Bird Road and 37th Avenue that surround the Property as well as the pedestrian and cyclist greenway proposed under the Metro -rail guideway to the South. The D zoning is no longer the most efficient or beneficial use of the Property, which is typically intended to accommodate higher intensity commercial uses which because of their specialized performance, scale, or impact should not be incorporated into a neighborhood structure. This area has seen a surge of revitalization with new residential developments and due to the proximity of the Metro Rail, T6-12-0 would be a more compatible zoning designation for the Property and help this area continue to redevelop in accordance with the principals of Miami 21. The proposed Project will continue the transition of development from lesser intense single-family residential development to more intensive development along major roadways and mass transit, satisfying the principal of succession which provides that the urbanized areas should transition in respect to intensity and density. The rezoning of the Property to T6-12-0 will allow appropriate successional change to continue and be consistent with the City's vision as expressed by Miami 21 and the City's Comprehensive Plan.
