This amendment changes the following: 1. Extends the pilot program period for an additional year.
2. Provides language to clarify that in the event that the certificate of use has been revoked by the Zoning
Administrator, the nonconforming use shall not be reinstated. 3. Provides a process for nonconforming
uses that have lapsed for a period of 18 months to five years to be allowed to be reinstated by Exception,
which requires a public hearing at the Planning, Zoning and Appeals Board.
Background Information:
The Pilot Program for nonconforming uses was established in 2011 for a period of two years to allow
for the reinstatement of nonconforming uses not compliant with Miami 21 regulations. The purpose
was to assist business owners that had been impacted by the economy as well as allow a transition
period between the implementation of Miami 21 and nonconforming businesses. The Pilot Program
was consequently extended until August 1, 2015 by the City Commission via resolution.
