HomeMy WebLinkAboutR-15-0310City of Miami Legislation Resolution: R-15-0310 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 15-00798 Final Action Date: 7/23/2015 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AN INTERLOCAL COOPERATION AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH MIAMI-DADE COUNTY, ESTABLISHING ACCOUNTING AND AUDITING PROCEDURES THAT TRACK THE USE OF E911 FUNDS RECEIVED BY THE CITY IN ACCORDANCE WITH CHAPTER 365, FLORIDA STATUTES, MORE SPECIFICALLY, SECTION 365.171 THROUGH SECTION 365.175, RELATING TO THE EMERGENCY COMMUNICATIONS NUMBER E911 ACT. WHEREAS, Miami -Dade County and the City of Miami ("City") both desire to continue providing citizens with a single, primary three -digit emergency phone number as outlined in Florida Statutes, Chapter 365, entitled "Use of Telephones and Facsimile Machines", specifically Sections 365.171 through Section 365.175, Florida Statutes, relating to Florida's Emergency Communications Number E911 Act ("Act"); and WHEREAS, the "E911" plan for enhanced 911 services is intended to provide citizens with rapid direct access to public safety agencies by accessing "911" with the objective of reducing the response time to situations requiring law enforcement, fire, medical, rescue, and other emergency services; and WHEREAS, the Act establishes the E911 Board with authority to levy a reasonable fee from voice communications services providers and provide funds to counties to pay certain costs associated with their E911 or 911 systems; and WHEREAS, local telephone exchange providers will bill their subscribers for the Emergency 911 fee, collect all Emergency 911 fees paid by subscribers, and then transfer such fees to the State of Florida, less a one (1) percent remuneration for administrative costs, the balance of the Emergency 911 fees; and WHEREAS, wireless telephone service providers will bill their subscribers for the Emergency 911 fees, collect all Emergency 911 fees paid by subscribers, and then transfer these fees to the E911 Board, less a one (1) percent remuneration for administrative costs, the balance of the Emergency 911 fees; and WHEREAS, the E911 Board will transfer a portion of these funds to Miami -Dade County pursuant to the Act; and WHEREAS, the intent of this Interlocal Agreement is to ensure that Miami -Dade County and the City establish strict accounting and auditing procedures that track the use of E911 fees in accordance with the Act to ensure the City receives its share of the E911 fees; and WHEREAS, this agreement shall be in effect from the date of signing and will expire on City of Miami Page 1 of 2 File Id: 15-00798 (Version: 1) Printed On: 3/16/2018 File Number: 15-00798 Enactment Number: R-15-0310 January 1, 2025; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute an Interlocal Cooperation Agreement, in substantially the attached form, with Miami -Dade County, establishing accounting and auditing procedures that track the use of E911 funds received by the City in accordance with Chapter 365 Florida Statutes, more specifically, Section 365.171 through Section 365.175, Florida Statutes, relating to the Emergency Communications Number E911 Act. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
