Subject: A resolution accepting a covenant running with the land between Oak Plaza Associates, LLC
and City of Miami for non-standard streetlights on County right-of-way within City limits.
Purpose of Item:
Resolution of the Miami City Commission accepting a covenant running with the land for streetlights.
Covenantor has requested permission from the City and County to construct non-standard Streetlights and
related structures, fixtures and improvements within the dedicated public rights -of -way that abut the Property
which may include portions of NE 2"d Avenue, a County maintained roadway, depicted in the attached Exhibit
"C", and for which the City has entered into an interlocal agreement with the County.
Background Information:
Resolution 15-00095 adopted by City Commission on February 12, 2015 allowed the City Manager to
execute 22 Covenants to run with the land with property owners in the Design District to construct
and maintain non-standard improvements including streetlights. The Developer will fund the
installation of the non-standard street lights on NE 2 Avenue, a County roadway, indemnify and hold
the City and County harmless for improvements, and be responsible for their maintenance in
perpetuity by way of a covenant to be accepted by the City Commission.
