A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE AN INTERLOCAL
AGREEMENT WITH MIAMI-DADE COUNTY, IN SUBSTANTIALLY THE ATTACHED
FORM, TO FACILITATE THE INSTALLATION AND MAINTENANCE OF
STREETLIGHTS WITHIN MIAMI-DADE COUNTY RIGHT-OF-WAY ALONG
CERTAIN PORTIONS OF NORTHEAST 2ND AVENUE, MIAMI, FLORIDA, AS
STATED HEREIN.
WHEREAS, Oak Plaza Associates, LLC. ("DACRA") has requested permission from the City of
Miami and Miami -Dade County to install nonstandard streetlights within the Miami -Dade County public
rights -of -way ("Improvements"), along certain portions of Northeast 2nd Avenue, Miami, Florida; and
WHEREAS, the City of Miami has requested permission to install nonstandard streetlights
within the Improvements, along certain portions of Northeast 2nd Avenue, Miami, Florida; and
WHEREAS, the City of Miami and Miami -Dade County are mutually desirous of providing
assurances for the future continued maintenance, repair and replacement of the Improvements; and
WHEREAS, the City of Miami shall be responsible for the operation and maintenance of the
Improvements; and
WHEREAS, the City of Miami shall enter into a covenant to run with the land with DACRA to
require DACRA to operate maintain and replace the Improvements and to hold harmless and
indemnify the City of Miami;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as fully set forth in this Section.
Section 2. The City Manager is authorized{1} to execute an Interlocal Agreement, in
substantially the attached form, to facilitate the installation and maintenance of the Improvements,
provided that DACRA has executed a covenant to require DACRA to install, operate, maintain and
replace the Improvements and to hold harmless and indemnify the City of Miami.
Section 3. This Resolution shall become effective immediately upon its adoption and signature
of the Mayor. {2}
