HomeMy WebLinkAboutSubmittal-Robin Porter-LetterEsteemed City of Miami Commissioners: My name is Robin Porter and I write you today as a concerned citizen and 13-year resident of historic Buena Vista East. My address is 122 NE 43`d Street. First and foremost, 1 am not in opposition to a museum being a part of the Design District. The ICA would be located 50 feet from the existing de la Cruz Collection Contemporary Art Space, which was built about five years ago with no special zoning accommodations. However, the ICA is asking to build a structure that is 70 feet tall, plus an additional 10 to 12 feet for AC equipment. That is well in excess of the T-4 current zoning limit of 40 feet, and would tower over neighboring homes, which are restricted to 25 feet under T-3. To change the T-4 and residential T-3 zoning would eliminate the buffer established in Miami 21 and would negatively affect our area - imagine a structure almost 3 times the height of your house being built within 500 feet (as in my case) or for some of my neighbors, within 100 feet. You, as city commissioners, are obligated by law to be stewards for good growth and development in the public interest. This is a difficult task, but you have Miami 21 to guide you. Miami 21 was developed with neighborhood input over a 3-year period, and is very specific in how zoning is supposed to protect neighborhoods by requiring buffers between higher density/intensity zones and lower density residential zones. Miami 21 does not permit developers with money and political connections to skirt the laws that everyone else is expected to abide by. You do what is correct and legal, according to Miami 21 and the Miami Comprehensive Neighborhood Plan (MCNP) and deny this zoning change. nr Lo.,_ I n 1_1 n 1/ Submitted into the public record for item(s) Z • l f Z. a nn (.,- it' 2,0IS . ity Clerk Buena Vista East is one of the oldest neighborhoods in Miami, starting life as a small village and growing exponentially during the 1920's, during which time much of our signature architecture was built. Permitting a contemporary art museum and sculpture garden is one thing, but quite another when it sacrifices that historic character only protected in less than 2% of the City of Miami, but also goes against Miami 21 AND the Miami Comprehensive Neighborhood Plan. The sections of the Comp Plan that are violated by this application include: LU 1.3.14, LU 1.6.9, HO 1.1.5, HO 1.1.8, the full text of which is provided in your packet. To approve the ICA in its current form violates specific requirements and the intent of Miami 21 - it leaves us with no transitional spaces, abutting a building that is almost 3 times the height of any residential building in historic BVE, and does NOT contribute to the historic aspect of our neighborhood. The City's own code indicates this in no unclear terms. I expect you all to do what is correct according to Miami 21 and MCNP. The law governs all of us equally.
