A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING AND
DIRECTING THE FILING OF A MAINTENANCE MAP TO MEMORIALIZE THE
DEDICATION OF SOUTH BAYHOMES DRIVE, PARK LANE, AND PARK COURT,
MIAMI, FLORIDA, TO THE PUBLIC BASED ON MAINTENANCE AND REPAIR
DURING THE IMMEDIATE PAST SEVEN (7) YEARS, IN ACCORDANCE WITH
FLORIDA STATUTES SECTION 95.361, AS STATED HEREIN.
WHEREAS, South Bayhomes Drive, Park Lane, and Park Court, Miami, Florida (collectively
the "Private Streets") were private streets under the jurisdiction of the property owners of the
Bayhomes Subdivision; and
WHEREAS, the City of Miami ("City") repaired and maintained South Bayhomes Drive in the
1950's, and thus, there is a memo stating that South Bayhomes Drive was public as of 1952 based
on the improvements by the City; and
WHEREAS, the City previously improved South Bayhomes Drive pursuant to Resolution No.
93-589; and
WHEREAS, the City has regularly maintained and repaired the Private Streets during the
immediate past seven (7) years; and
WHEREAS, based upon this maintenance and repair, the Private Streets are deemed to be
dedicated to the public pursuant to Florida Statutes Section 95.361; and
WHEREAS, in accordance with Florida Statutes Section 95.361, the City wishes to
memorialize the dedication to the public by the filing of a maintenance map in the office of the Clerk
of the Court of Miami -Dade County;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings set forth in the Preamble to this Resolution are hereby
adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section 2. The City Manager is authorized{1} and directed to file a maintenance map, in the
office of the Clerk of the Circuit Court of Miami -Dade County, to memorialize the dedication of the
Private Streets to the public based on maintenance and repair during the immediate past seven (7)
years, to show they have vested in the City pursuant to Florida Statutes Section 95.361(2).
Section 3. This Resolution shall become effective immediately upon its adoption and signature
of the Mayor.{2}

{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10)
calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission.
