("FEC"), TO AMEND THE LOCATION OF THE EASEMENT RESERVED TO FEC ON THAT CERTAIN SPECIAL WARRANTY DEED DATED JUNE 6, 1988, AND RECORDED IN OFFICIAL RECORDS BOOK 13782, PAGE 502 OF THE PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA, WITH TERMS AND CONDITIONS MORE PARTICULARLY DESCRIBED IN THE AMENDMENT. WHEREAS, the City of Miami ("City") executed that certain Special Warranty Deed dated June 6, 1988, and recorded in Official Records Book 13782, Page 502 of the Public Records of Miami -Dade County, Florida (the "Deed"), pursuant to which Florida East Coast Railway, L.L.0 ("FEC") conveyed its right title and interest in the property defined therein to the City, but reserved for itself an easement ("Easement"); and WHEREAS, the City and FEC desire to amend the location of the Easement, subject to the terms and conditions contained in the Amendment to Reservation of Easement ("Amendment"); and WHEREAS, the change in the location of the Easement does not result in any enlargement of the Easement area; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is hereby authorized{1 } to execute an Amendment, in substantially the attached form, to FEC, to amend the location of the easement reserved to FEC on that certain Special Warranty Deed dated June 6, 1988, and recorded in official records book 13782, page 502 of the public records of Miami -Dade County, Florida with terms and conditions more particularly described in the Amendment. Section 3.
