A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A LICENSE AGREEMENT, IN
SUBSTANTIALLY THE ATTACHED FORM, WITH THE FLORIDA DEPARTMENT OF
TRANSPORTATION ("FDOT"), FOR A PERIOD ENDING NO LATER THAN THE
LAST DAY OF FEBRUARY, 2018, ENCOMPASSING APPROXIMATELY TEN (10)
FEET OF A PORTION OF CITY -OWNED PROPERTY LOCATED AT 2200 WEST
FLAGLER STREET, MIAMI, FLORIDA ("PROPERTY"), AS MORE PARTICULARLY
DESCRIBED IN EXHIBIT "A," ATTACHED AND INCORPORATED; THE LICENSE
BEING USED SOLELY FOR THE SLOPING, TYING IN, HARMONIZING, AND
RECONNECTING OF EXISTING FEATURES OF THE PROPERTY WITH THE
ROADWAY IMPROVEMENTS CONDUCTED BY FDOT AT SAID LOCATION.
WHEREAS, the City of Miami ("City") owns the property located at 2200 West Flagler Street
Miami, Florida ("Property"); and
WHEREAS, the Florida Department of Transportation ("FDOT") is planning the milling and
resurfacing of State Road 968, also known as West Flagler Street ("Project"); and
WHEREAS, FDOT has requested a License Agreement ("License") encompassing
approximately ten (10) feet of a portion of the sidewalk on the Property, more particularly described in
Exhibit "A," attached and incorporated; and
WHEREAS, the License will be used solely for the sloping, tying in, harmonizing, and
reconnecting of existing features of the Property with the roadway improvements being conducted by
FDOT at said location;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby
adopted by reference and incorporated as fully set forth in this Section.
Section 2. The City Manager is hereby authorized{1} to execute a License, in substantially the
attached form, with FDOT, for a period ending no later than the last day of February, 2018,
encompassing approximately ten (10) feet of a portion of City -owned property located at 2200 West
Flagler Street, Miami, Florida. The License will be used solely for the sloping, tying in, harmonizing,
and reconnecting of existing features of the Property with the roadway improvements being
conducted by FDOT at said location.
Section 3. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.{2}

{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10)
calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission
