Dear Mayor Regalado, City of Miami Commissioners, City Attorney Mendez, Planning Director Garcia and other city
officials,
Attached are two letters of opposition to the proposed rezoning of the lot at 5907 NE 5 Avenue, from single-family
residential to commercial, which is on the City Commission agenda of March 26, 2015 as items PZ.4 and PZ.5.
These letters are from myself and my sister Karen Jacobsen, as we own the two houses across the street from the
subject property.
The letters were officially time stamped and accepted by the City of Miami planning department at 1:50 pm today, March
18, 2015.
I respectfully request that these letters be made part of the official file on these two items, and that they be posted on-line
with the other agenda attachments.
I have also copied below into the body of this email the content of my letter.
I ask that you seriously consider this matter and protect the historic Palm Grove residential neighborhood from
commercial encroachement by denying the rezoning.

Dear Miami City Commissioners,
As the owner of the home at 5900 NE 5 Avenue, I am strongly opposed to the change in zoning being sought by the property owners of
5907 NE 5 Avenue.
I grew up in my house. It has been in my family since 1955. It is unconscionable to me that the city would even consider supporting
allowing commercial zoning to encroach into a single-family neighborhood, especially when that single-family neighborhood is a
historic district — the Palm Grove Historic District.
This proposed change would put a commercial business directly in front of my house. Should this be challenged in court as inconsistent
with the Comprehensive Plan, I will have standing as an aggrieved party under FS 163.3215. I was present when the PZAB plainly
stated that it was inconsistent with the comprehensive plan before it voted 7-1 to deny. I hope the commission votes similarly, as my
quality of life and my property's value would be harmed by the proposed land use and zoning change.

I attended a meeting at Legion Park where the architect gave a presentation to the neighbors about a proposed furniture store for that
location. He did not mention that the change in zoning would violate the comprehensive plan, or that it was spot zoning, or that if the
furniture store goes out of business, any other business could occupy that location, even a fast-food restaurant.

neighborhood, only a hundred feet from my property. Should this be challenged in
court as inconsistent with the Comprehensive Plan, I will have standing as an

similarly, as my quality of life and my property's value would be harmed by the

I hope you consider how you or your family might feel if this up -zoning were proposed
next to and near your home, and that you will do the right thing and vote to deny this
change in zoning.
