Subject: Section 35-220 of the City Code: Required off-street parking and payment in lieu of required off-street
parking
Purpose of Item:
To provide clarity and correct language as to exclusions of parking reductions and relaxation of parking
requirements within already established parking trust funds.
Background Information:
The intent of the Code of the City of Miami, Florida is to allow payment in lieu of off-street minimum parking
requirements through the parking trust funds; created in specific areas where a concentration of sites have been
identified in which minimum parking requirements may not be accommodated on -site. Improvements funds are
in the best interest of the community since they are established and intended to facilitate public off-street
parking, infrastructure improvements and maintenance and marketing to serve the area. It is for this reason that
the relaxations of parking requirements allowed pursuant to Miami 21 are not made available in areas where
improvements funds have been established.
This amendment to Section 35-220 is a companion item to the Miami 21 Article 7.2.8 Nonconforming Site
Improvements (File ID # 14-01075zt) scheduled to be heard by the City Commission on March 26, 2015.
Article 7.2.8 is being amended to clarify previously approved language and further meet the intent of the code
to allow non -conforming Buildings with less than the required on -site parking or no parking to continue to
exist with vested rights. IIowever, when the site is within an area where an improvement trust fund has been
established, parking vested rights for adaptive reuses shall not be made available pursuant to Chapter 35 of the
City Code and thus the clarification provided herein.
