HomeMy WebLinkAboutLegislation FR/SRCity of Miami Legislation Ordinance City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 15-00234 Final Action Date: AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 35, ARTICLE V OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "COCONUT GROVE BUSINESS DISTRICT AND DESIGN DISTRICTS PARKING IMPROVEMENT TRUST FUNDS," TO CLARIFY AND CORRECT LANGUAGE AS TO EXCLUSIONS OF PARKING REDUCTIONS AND RELAXATION OF PARKING REQUIREMENTS WITHIN THE ALREADY ESTABLISHED PARKING TRUST FUND; CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, it has been identified that some areas within the City of Miami ("City") may possess a concentration of sites where minimum parking requirements may not be accommodated on -site; and WHEREAS, parking trust funds have been established to allow payment in lieu of off-street minimum parking requirements; and WHEREAS, it is the intent of the City to facilitate public off-street parking, infrastructure improvements and maintenance, and marketing to serve the area through improvement trust funds; and WHEREAS, the City Commission sees this ordinance as in the best interest of the community; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION FOR THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as fully set forth in this Section. Section 2. Chapter 35/Article V of the Code of the City of Miami, Florida, as amended ("City Code"), is amended in the following particulars:{1} "CHAPTER 35 MOTOR VEHICLES AND TRAFFIC * ARTICLE V COCONUT GROVE BUSINESS DISTRICT AND DESIGN DISTRICT PARKING IMPROVEMENT TRUST FUNDS City of Miami Page 1 of 2 File Id: 15-00234 (Version: 1) Printed On: 3/16/2015 File Number: 15-00234 Sec. 35-220. Required off-street parking and payment in lieu of required off-street parking The minimum off-street parking requirements shall be as depicted herein and in the zoning ordinance of the city. Said minimum parking requirements may be satisfied by providing the parking as stated in the zoning ordinance or by payment in lieu of required off-street parking, as described herein. Parking Reductions, Off -site Parking, or any other relaxation of parking requirements used to calculate the wai„ers granted herein, no parking requirements shall be diminished below that which was provided prior to the adoption of the allowed pursuant to the Miami 21 Code, prior to October 22, 2009, shall not be made available within areas of the city for which a parking trust fund has been established and is in effect pursuant to this chapter. Section 3. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
