A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
CLOSING, VACATING, ABANDONING AND DISCONTINUING FOR PUBLIC USE
PORTIONS OF STREETS APPROXIMATELY LOCATED AT NORTHEAST 1ST
COURT SOUTH OF NORTHEAST 31 ST STREET TO APPROXIMATELY 150 FEET
NORTH OF NORTHEAST 29TH STREET; AND NORTHEAST 30TH STREET
BETWEEN NORTHEAST 2ND AVENUE AND NORTHEAST 1ST COURT; AND
NORTHEAST 31ST STREET BETWEEN NORTHEAST 2ND AVENUE AND THE
F.E.C. RAILROAD, MIAMI, FLORIDA.
WHEREAS, the Plat and Street Committee, at its meeting on March 5, 2015, reviewed the
subject tentative plat entitled "Buena Vista Venture" and determined that all technical requirements
have been met and by a vote of six to zero (6-0), recommended approval of the vacation and closure
as set forth; and
WHEREAS, the Department of Public Works and the Plat and Street Committee have studied the
subject vacation and closure and determined that it will not affect pedestrian or vehicular traffic
circulation or access for public service; and
WHEREAS, the Miami Planning, Zoning and Appeals Board, at its meeting on March 18, 2015,
following an advertised public hearing, adopted Resolution No. PZAB-R-15-007 by a vote of nine to
zero (9-0), Item no. 1, recommending APPROVAL of the vacation and closure as set forth; and
WHEREAS, the City Commission finds that it is in the best interest of the general welfare of the
City of Miami and its inhabitants to grant the vacation and closure of a portion of the public
right-of-way as hereinafter described, and deems it advisable to do so;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The portions of streets approximately located at Northeast 1st Court south of Northeast
31 st Street to approximately 150 feet north of Northeast 29th Street; and Northeast 30th Street
between Northeast 2nd Avenue and Northeast 1st Court; and Northeast 31 st Street between
Northeast 2nd Avenue and the F.E.0 Railroad, Miami, Florida, more particularly described in Exhibit
"A," are closed, vacated, abandoned and discontinued for public use.
Section 3. Approval of the requested vacation and closure shall be valid for a period of four (4)
years and shall remain independent of the referenced tentative plat during this period.

Section 4. The approved final plat must be recorded within the four (4) year approval period of the
requested vacation and closure. At least thirty (30) days before the public hearing before the City
Commission on this final plat, the applicant shall have recorded a covenant in the public records of
Miami -Dade County affirming that the development of the Property is in conformity with a site plan
approved by the Department of Planning and Zoning. The covenant shall be acceptable to the
Department of Planning and Zoning, acting by and through its Director and the Office of the City
Attorney. No permits will be issued by the City, including phased permits, until the final plat has been
recorded.
Section 5. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {1}
Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
