The intent of the vacation and closure of these street segments is to create a unified development site consistent in size to the nearby Midtown Miami. The closure may allow development that could include retail and restaurants at ground level which is conducive to pedestrian activity and circulation of the general public. 2. The three (3) existing streets proposed to be closed and vacated are located completely within the boundaries of the Tentative Plat site and do not extend or interconnect beyond the limits of the same. The site is currently vacant, and the roadways are currently not utilized by emergency or service vehicles beyond the limits of the site and the site itself requires limited service. Solid waste service is provided by private commercial carriers. 3. Adverse effects on the ability to provide emergency services is not anticipated. The proposed new development will be required to provide adequate emergency access. Currently, there is no access through the limits of the site. 4. The proposed streets to be closed and vacated are currently not part of the general neighborhood vehicular or pedestrian circulation system. The future development, consisting of residential, retail, restaurants and commercial, shall provide enhanced pedestrian and vehicular circulation to serve the property. On April 3, 2014, the City's Plat and Street Committee members voted to recommend seven (7) ayes and zero (0) nays for the request of this three (3) street closures. 6. Due to reconfiguration of the plats, on March 05, 2015, the City's Plat and Street Committee members reviewed the revised tracts and street closure requests. The City's Plat and Street Committee members voted six (6) ayes and zero (0) nays, recommending approval for the closure and vacation of the three streets. 7. As proposed, this application is consistent with the goals, objectives and policies of the Miami Comprehensive Neighborhood Plan (MCNP). The closure of these roadways will promote and facilitate cohesive development, economic growth and revitalization of the lots that it abuts. DETERMINATION Based on the above findings, the Planning and Zoning Department recommends the Approval of the request subject to the following conditions: 1- A minimum of 30 days prior to scheduling of the Street Closures for second reading City Commission, the applicant shall provide site and elevation plans along with a covenant for the review and approval of the Planning and Zoning Director or their Designee. 2- The proposed development shall comply with all applicable requirements of Miami 21 Code and City of Miami Code of Ordinance. 3- The applicant shall comply with the requirements of all applicable departments/agencies as part of the City of Miami building and street vacation permit process. Railway Right of Way and west of N.E. 2' Avenue. The Owner is the owner of approximately 6.623 acres of land located between N.W. 2" Avenue and the Florida East Coast Railway Right of Way. This application seeks the vacation and closure of three street segments that bisect these lots: NE 1st Court, NE 30th Street and NE 31 st Street. These street segments were created in 1906 (PB B, Page 119) and 1913 (PB 3 PG 60) when these lands were platted to create industrial parcels next to the Florida East Coast Railway. Just as Midtown Miami was built on the site of the abandoned FEC Buena Vista Railyards, the Owner's properties were also railway -oriented properties. Some of the lands were the a distribution facility for United Fruit company and Chiquita bananas. In fact, many still referred to this site as the "Chiquita Property." Redevelopment of these properties is a natural extension of the successful Midtown Miami District. Closure of these rights of way to create a unified development that provides better pedestrian and vehicular access is the first step in the transformation of these former industrial sites. The revitalization of this site with development mirroring the urban mixed uses of Midtown will bridge the gap between Midtown and Biscayne Boulevard. In fact, the street closure requests of this application are nothing new. I West Palm Beach Mr. Francisco Garcia November 25, 2014 Page 2 Commission approved Resolution No. R-04-0801 closing most of the same streets and rights of way subject to this request. Section 55-15(h) of the City Code provides that "[a]pproval of the requested vacation and closure shall be valid for a period of four years and shall remain independent of the referenced tentative plat during this period. The approved final plat must be recorded within the four-year approval period of the requested vacation and closure." The Code does not provide for extensions of time for the road closure approvals. The plat proposed as part of 2004 street closure was not approved and recorded within the 4 years required by Section 55-15(h). In 2008, the, then owners of the surrounding land, filed a second street closure application, this time exactly as the one requested by this application. Again, on September 25, 2008, the City Commission approved the road closure by Resolution R-08-0548. Unfortunately, the plat for that road closure was also not finalized before the four year expiration of the street closure approval. Since the Code does not provide for an extension of time of this 4 year period, this new application requesting the road closure is necessary. Furthermore, as in previous times, the closing of these streets meets the criteria of Section 55-15 (c) of the City Code as follows: (1) Is it in the public interest, or would the general public benefit from the vacation of the rights -of -way or easements? The general public does not use this street for pedestrian or vehicular access. In addition, closing the street will permit the development of the property with adequate pedestrian amenities and safe vehicular access. . (2) Is the general public no longer using the rights -of -way or easement, including public service vehicles such as trash and garbage trucks, police, fire or other emergency vehicles? The general public does not use this segment of street for access or for public service vehicles, or emergency access. All structures associated with the industrial uses on the site have been demolished and the properties are gated. (3) Would there be no adverse effect on the ability to provide police, fire or emergency services? Neither fire, police nor emergency services currently use these street. All the structures on the site have been demolished. Closing these rights of way will have no adverse effect on the ability to provide services. On the contrary, the street closures will permit the development of the parent site, which will have to be designed to improve police, fire and emergency services, as well as vehicular and pedestrian circulation and traffic. As stated for criteria (1), above, the general public does not use this street for pedestrian access or vehicular access. On April 10, 2014, the City's Plat and Street Committee considered this request for vacation and closure of the streets and voted 7-0 in favor of the vacation and closure request.
