RE: Application for Official Vacation and Closure of a portion of NE 1st Court, a
portion of NE 30th Street and a portion of NE 31 st Street
Dear Mr. Garcia:
This firm represents Midtown Opportunities XIIIB, LLC, Midtown Opportunities XIVB,
LLC and Midtown Opportunities XVB, LLC (collectively referred to as "Owner") the Owner of
certain lands in the City of Miami requesting the official vacation and closure of right of way for
portions of NE 1st Court, NE 30th Street and NE 31 st Street, located east of the F.E.C. Railway
Right of Way and west of N.E. 2' Avenue.
The Owner is the owner of approximately 6.623 acres of land located between N.W. 2"
Avenue and the Florida East Coast Railway Right of Way. This application seeks the vacation
and closure of three street segments that bisect these lots: NE 1st Court, NE 30th Street and NE
31 st Street. These street segments were created in 1906 (PB B, Page 119) and 1913 (PB 3 PG
60) when these lands were platted to create industrial parcels next to the Florida East Coast
Railway. Just as Midtown Miami was built on the site of the abandoned FEC Buena Vista
Railyards, the Owner's properties were also railway -oriented properties. Some of the lands were
the a distribution facility for United Fruit company and Chiquita bananas. In fact, many still
referred to this site as the "Chiquita Property."
Redevelopment of these properties is a natural extension of the successful Midtown
Miami District. Closure of these rights of way to create a unified development that provides
better pedestrian and vehicular access is the first step in the transformation of these former
industrial sites. The revitalization of this site with development mirroring the urban mixed uses
of Midtown will bridge the gap between Midtown and Biscayne Boulevard. In fact, the street
closure requests of this application are nothing new. On December 9, 2004, the City

Commission approved Resolution No. R-04-0801 closing most of the same streets and rights of
way subject to this request.
Section 55-15(h) of the City Code provides that "[a]pproval of the requested vacation and
closure shall be valid for a period of four years and shall remain independent of the referenced
tentative plat during this period. The approved final plat must be recorded within the four-year
approval period of the requested vacation and closure." The Code does not provide for
extensions of time for the road closure approvals.
The plat proposed as part of 2004 street closure was not approved and recorded within
the 4 years required by Section 55-15(h). In 2008, the, then owners of the surrounding land,
filed a second street closure application, this time exactly as the one requested by this
application. Again, on September 25, 2008, the City Commission approved the road closure by
Resolution R-08-0548. Unfortunately, the plat for that road closure was also not finalized
before the four year expiration of the street closure approval. Since the Code does not provide
for an extension of time of this 4 year period, this new application requesting the road closure is
necessary.
Furthermore, as in previous times, the closing of these streets meets the criteria of Section
55-15 (c) of the City Code as follows:
(1) Is it in the public interest, or would the general public benefit from the
vacation of the rights -of -way or easements?
The general public does not use this street for pedestrian or vehicular access. In addition, closing
the street will permit the development of the property with adequate pedestrian amenities and
safe vehicular access. .
(2) Is the general public no longer using the rights -of -way or easement, including
public service vehicles such as trash and garbage trucks, police, fire or other
emergency vehicles?
The general public does not use this segment of street for access or for public service vehicles, or
emergency access. All structures associated with the industrial uses on the site have been
demolished and the properties are gated.
(3) Would there be no adverse effect on the ability to provide police, fire or
emergency services?
Neither fire, police nor emergency services currently use these street. All the structures on the
site have been demolished. Closing these rights of way will have no adverse effect on the ability
to provide services. On the contrary, the street closures will permit the development of the
parent site, which will have to be designed to improve police, fire and emergency services, as
well as vehicular and pedestrian circulation and traffic.

(4) Would the vacation and closure of the rights -of -way or easements have a
beneficial effect on pedestrian and vehicular circulation in the area?
As stated for criteria (1), above, the general public does not use this street for pedestrian access
or vehicular access.
On April 10, 2014, the City's Plat and Street Committee considered this request for
vacation and closure of the streets and voted 7-0 in favor of the vacation and closure request.

WHEREAS, the Miami Zoning Board at its meeting on November 8, 2004, Item No. 4, duly adopted
Resolution No. ZB 2004-0945 by a five to zero (5-0) vote, RECOMMENDING APPROVAL with
conditions of closing, vacating, abandoning. and discontinuing a portion of a public right-of-way as set
forth; and
WHEREAS, the Department of Public Works and the Plat and Street Committee have studied the
subject vacation and closure and determined that it will not affect pedestrian or vehicular traffic
circulation or access for public service; and
WHEREAS, the Plat and Street Committee at its meeting of October 7, 2004, reviewed the subject
tentative plat and determined that all technical requirements have been met; and
WHEREAS, the City Commission, finds that it is in the best interest of the general welfare of the
City of Miami and its inhabitants to grant the vacation and closure of a portion of the public right-of-way
as hereinafter described, and deems it advisable to do so;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. A portion of approximately Northeast lst Court from Northeast 31 st Street to 135 feet
south of Northeast 30th Street, Northeast 30th Street from Northeast 1st Court to Northeast 2nd
Avenue and Northeast 31 st Street from Northeast 2nd Avenue to, the Florida East Coast Railway,
subject to the following conditions by the Planning and Zoning Department: 1) the proposed site

development shall include a Mininiuntat fifteen percentof open space -and -21-the applicant•shaft• • •

Department to accommodate a streetcar stop and public access between Northeast 2nd Avenue and
the Florida East Coast Corridor in substantial conformance with Section 55-1(c)(2) of the subdivision
regulations, more particularly described in Exhibit "A," is closed, vacated, abandoned and discontinued
for public use_
Section 3. This Resolution shall become effective immediately upon its adoption and signature of

ENCLOSURES:
At the March 5, 2015 Plat and Street Committee meeting, two street closure
appiications were reviewed. The results of the Committee's review of the public interest
findings concerning the closures are summarized as follows:
"BUENA VISTA VENTURE" (NE 30 Street and NE 31 Street between NE 2 Avenue and
the FEC Railroad and NE 1 Court between NE 29 Street and NE 31 Street)
1. The closure of the roadways will create a unified development site compatible
with the MidTown Miami concept. The project will include retail and restaurants
on ground level conducive to pedestrian activity and circulation and available to
the general public.
2. The existing roadways to be closed and vacated are located completely within
the boundaries of the tentative plat site and do not extend or interconnect
beyond the limits of the tentative plat site. The site is now vacant. The roadways
are not utilized by emergency or service vehicles beyond the limits of the site and
the site itself requires limited service. Solid waste service is provided by private
commercial carriers.
3. There will be no adverse effect on the ability to provide emergency services. The
new development will be required to provide adequate emergency access. There
is no through access required beyond the limits of the site.
4. The roadways to be closed and vacated are not part of the general
neighborhood vehicular or pedestrian circulation system. The new development,
consisting of residential, retail, restaurants and commercial, will provide
enhanced pedestrian and vehicular circulation to serve the property,

of this street closure request.
"LIFE SCIENCE TECHNOLOGY PARK" (NW 18 Street from NW 7 Avenue to
approximately 100 feet east of NW 7 Avenue)

The City of Miami Plat and Street Committee, at its meeting of April 3, 2014 approved the above tentative
plat subject to the following revisions being made to the tentative plat, additional information being
provided and/or variances being granted. Please be advised that the processing of your tentative plat cannot
proceed until these conditions have been satisfied:
1. Explain how the covenant for parking, recorded in OR 12300, PG 2135, will affect proposed Tracts
A and C.
2. Obtain releases of the existing easements in proposed Tract A.
3. The existing utilities in the right-of-way to be vacated and closed must be relocated or easements
must be provided.
4. The City of Miami must join in and be part of the plat since the City owns portions of NE 2 Avenue
and NE 21 Street per OR 12923, PG 2197 and OR 12743, PG 4868
5. All encroachments across lot lines and the right of way dedication area must be removed prior to
the final plat.
6. Provide right-of-way dedication information along NE 2 Avenue.
7. Tentative plat application must be made with Miami -Dade County after receiving approval from the
City of Miami Plat and Street Committee.
8. Backup documentation will be required for all who execute the final plat. A resolution for authority
to execute document and a Certificate of Good Standing from the Secretary of State is required, if
applicable.
9. An Opinion of Title, in the City of Miami Opinion of Title form, must be provided at the time of
final plat submittal.
10. Be advised that an incomplete final plat package will not be accepted by the City of Miami. It is the
owner's responsibility to work with his surveyor and his attorney to assure that everything is in
order before submitting the final plat package.
11. Be advised that if all requirements for scheduling the final plat for City Commission action are not
in order, the final plat will not be scheduled for a City Commission meeting.
12. A letter from Comcast is required to determine if any adjustments to their facilities or easements are
required
13. Provide a correct address for the owners on the application.

14. In the location sketch and title block, provide a fractional sectional description.
15. Provide a properly executed tentative plat application.
16. On the application, correct the street boundaries of the proposed plat.
17. Add the abbreviations for the curve data to the legend.
18. Revise the legal description to exclude the roadways to be closed and vacated.
19. Specify the units of the flood criteria.
20. Show the areas to be dedicated by this plat by using a solid line for existing right of way lines and a
dashed line for the zoned right of way lines.
21. Show the existing underground storm sewer information including inverts, pipe size, pipe material,
and direction.
22. Add "hatching" pattern to the legend.
23. Provide a tie to the nearest section corner and provide a Certified Corner Record.
24. A letter of concurrency from Miami -Dade County School Board is required prior to the final plat
approval (see contact sheet).
25. Provide a zoning verification letter for Tract "A" that an exception to the maximum lot size is not
required.
26. Delete the note concerning the private road.
27. Provide a corporate resolution for each owner of the tentative plat property. Also, provide a
Certificate of Good Standing, as applicable.
28. Existing utilities in the streets to be closed and vacated must be relocated or easements provided.
29. An Opinion of Title as to the reversionary rights for the right-of-way to be closed and vacated will
be required by the Planning, Zoning and Appeals Board. The opinion of Title must also address
whether or not there are individuals, in addition to the abutting property owners, having an interest
in the rights -of -way to be closed and vacated. A copy of the Opinion of Title must be provided to
the Public Works Department.
30. The Planning, Zoning and Appeals Board will require a sketch and legal description with a square
footage, on an 8 I/2 x 11" paper, for the proposed closure. Contact the Office of the Hearing Boards,
at 305-416-2030. Provide a copy to the Public Works Department.
31. The Plat and Street Committee has reviewed the tentative plat of BUENA VISTA VENTURE and
determined that all technical requirements contained in the Miami City Code Subdivision
Regulations have been met and has approved the tentative plat. The members of the Plat and Street
Committee have further considered the request for vacation and closure of the streets and court with
respect to Miami City Code Requirements and have voted 7 in favor and 0 in denial of this vacation
and closure request.
In addition to the above requirements, you should be aware of the following:
1. State and local laws require the installation of various physical improvements in the public
rights -of -way when property is platted. These subdivision improvements include paving,
drainage, landscaping, sidewalks, etc. In some cases this could represent a substantial
investment on your part.
REQUIRED: The submission of an electronic copy of the tentative plat, in an AutoCAD
version, to the City of Miami Public Works Department, Roadway Plans Section will
EXPEDITE the preparation and enhance the ACCURACY of the subdivision improvement
letter required for the final plat approval.

2. The alteration, relocation or installation of utilities such as storm and sanitary sewers, electric,
telephone, water, etc., caused by this plat will be at the property owner's expense. Also, utility
easements may be required on the property being platted.
3. A building permit will not be issued on the property being platted until the fmal plat is recorded
or as authorized by the City of Miami Code Section 55-10(i). Also, the Certificate of
Occupancy for any building construction will be issued only after all the required subdivision
improvements have been completed.
4. Approval for fire flow requirements must be obtained from the Fire -Rescue Department prior
to the issuance of a building peiuiit.
5. In order to mitigate problems associated with access and construction activities throughout the
neighborhood, the contractor/developer is encouraged to notify the affected neighborhood
residents, in writing, of the project starting and completion dates at the time of issuance of
permits. The contractor/developer may coordinate the notification of residents with the local
City of Miami NET Service Center.
6. Additional items must be provided to the City of Miami Department of Public Works before
the fmal plat is submitted to the City Commission for approval. You will be notified in writing
as to what these items are after the amount of the bond has been determined for the necessary
subdivision improvements.
7. Tentative plat approval is only valid for one (1) year and six (6) months from the date of the
Plat and Street Committee meeting at which time it was approved.

Miami Datum. These plans shall clearly show dimensions between the base building lines and the City
of Miami monument lines. All plans must be submitted to the Department of Public Works
Development and Roadway Plans Section for review and approval prior to the application and
issuance of any permits and plat final approval. Reasonable time must be allocated for the proper review
of the construction plans by City personnel. A reproducible Mylar of the approved plans (standard size 24" x
36") shall be submitted to the Department of Public Works Development and Roadway Plans Section prior
to the application and issuance of any building or construction permits on the property being platted.
Construction of the subdivision improvements shall not commence until your contractor has obtained the
required permits and applicable covenants. A line & grade permit fee must be paid by your contractor for
new construction of any major alteration of buildings. A line & grade permit is also required for new
sidewalk, curb and gutter, fences and walls with reinforced concrete foundations, and other structures to be
constructed within ten (10) feet of the base building line. An excavation permit fee must be paid by your
contractor if new drainage structures or other underground utilities are to be installed. Your contractor should
check with the Right of Way Permits Section of the Department of Public Works for maintenance of traffic
permits. Any construction on a state road including relocation of utility or light poles will also require a
permit from the Florida Department of Transportation. Your surveyor will be responsible for the layout and
final measurements of the subdivision improvements. Field books and reproducible Mylar sheets of the "as -
built" survey shall be submitted to the Development and Roadway Plans Section for approval prior to the
release of the subdivision improvement bond.
The landscaping estimate, when included, is based on full coverage of solid sod and planting of specified
trees. The owner(s) will be required to guarantee the landscaping for one year after the subdivision
improvements have been accepted by the Department of Public Works.
Water service requirements are not included in the improvements listed above. For information concerning
water mains and appurtenances, contact Miami -Dade Water & Sewer Department at 305-665-7471.
When the final plat has been prepared by your surveyor, it is to be submitted to the Department of Public
