PROJECT ADDRESS: A portion of NE 1st Court, south of NE 31st Street to approximately 150 feet north of NE 29th Street; a portion of NE 30th Street, between NE 2"d Avenue and NE 1st Court; a portion of NE 31st Street, between NE 2"d Avenue and the F.E.0 Railway Right -of -Way. The intent of the vacation and closure of these street segments is to create a unified development site consistent in size to the nearby Midtown Miami. The closure may allow development that could include retail and restaurants at ground level which is conducive to pedestrian activity and circulation of the general public. 2. The three (3) existing streets proposed to be closed and vacated are located completely within the boundaries of the Tentative Plat site and do not extend or interconnect beyond the limits of the same. The site is currently vacant, and the roadways are currently not utilized by emergency or service vehicles beyond the limits of the site and the site itself requires limited service. Solid waste service is provided by private commercial carriers. 3. Adverse effects on the ability to provide emergency services is not anticipated. The proposed new development will be required to provide adequate emergency access. Currently, there is no access through the limits of the site. 4. The proposed streets to be closed and vacated are currently not part of the general neighborhood vehicular or pedestrian circulation system. The future development, consisting of residential, retail, restaurants and commercial, shall provide enhanced pedestrian and vehicular circulation to serve the property. On April 10, 2014, the City's Plat and Street Committee members voted to recommend seven (7) ayes and zero (0) nays for the request of this three (3) street closures. 6. Due to reconfiguration of the plats, on March 05, 2015, the City's Plat and Street Committee members reviewed the revised tracts and street closure requests. The City's Plat and Street Committee members voted six (6) ayes and zero (0) nays, recommending approval for the closure and vacation of the three streets. 7. As proposed, this application is consistent with the goals, objectives and policies of the Miami Comprehensive Neighborhood Plan (MCNP). The closure of these roadways will promote and facilitate cohesive development, economic growth and revitalization of the lots that it abuts. DETERMINATION Based on the above findings, the Planning and Zoning Department recommends the Approval of the request subject to the following conditions: 1. A covenant will be recorded tying the property to a site plan approved by Planning Department at least 30 days before City Commission hearing on the final plat. 2. No permits will be issued by the City, including phased permits, until recording of the final plat. 3. The PZAB resolution including these conditions and approving the street closure shall be recorded within 30 days of approval by the City Commission.
