BACKGROUND INFORMATION
On October 10, 2013, the City of Miami Commission adopted Resolution No. R-13-0407, authorizing
the City of Miami to enter into three related easements with Brickell CityCentre Project, LLC to
improve the land above and below SE 6 Street between South Miami Avenue and SE 1 Avenue: the
Temporary Construction Easement, the Subsurface and Maintenance Easement and the Aerial Easement.
These easements were all entered into and recorded with an effective date of January 31, 2014.
Since the date of execution, Brickell CityCentre Project, LLC has determined that the boundaries of the
Temporary Construction Easement and the Subsurface and Maintenance Easement must be slightly
modified to successfully complete its planned connections between the buildings. Brickell CityCentre
Project, LLC is thus requesting to modify the boundaries of these easements. This proposed
modification will not result in any net increase or decrease in the square footage granted to Brickell
CityCentre Project, LLC by the Temporary Construction Easement and the Subsurface and Maintenance
Agreement, and it will not affect the Aerial Easement in any way. All other terms and conditions of the
Temporary Construction Easement and the Subsurface and Maintenance Easement continue in operative
force and effect.
