HomeMy WebLinkAboutO-13518City of Miami Legislation Ordinance: 13518 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 15-00356 Final Action Date: 5/14/2015 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 23/ARTICLE I OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "HISTORIC PRESERVATION/HISTORIC PRESERVATION" MORE PARTICULARLY BY AMENDING SECTION 23-6.4 ENTITLED "SIGNAGE," TO CLARIFY THE DEFINITION OF DISTRICT MARKER SIGN, AND TO EXEMPT DISTRICT MARKER SIGNS FROM CERTAIN REQUIREMENTS; CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, District Marker signs marking the entrance to cultural specialty districts and historic districts serve to identify the area, mark a historic destination for visitors, and reinforce the neighborhood's character as a destination for art, culture, dining, and entertainment; and WHEREAS, the City of Miami desires to permit District Marker signs subject to certain requirements; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as fully set forth in this Section. Section 2. Chapter 23 of the Code of the City of Miami, Florida, as amended, entitled "Historic Preservation," is amended in the following particulars:{1} "CHAPTER 23 HISTORIC PRESERVATION ARTICLE I . HISTORIC PRESERVATION Sec. 23-6.4 Signage. A. Historic signs B. District Marker signs. i. Definitions. District Marker Sign is an artistic sign that has been in existence for at least twenty years which is City of Miami Page 1 of 2 File Id: 15-00356 (Version: 2) Printed On: 2/27/2018 File Number: 15-00356 Enactment Number: 13518 painted on the side of a building and marks the entrance to a neighborhood, park, or other designated historic, public or geographical area that serves to identify the area, mark a historic destination for visitors, and reinforce the neighborhood's character as a destination for art, culture, dining, and entertainment. ii. Exemptions. In areas designated Cultural Specialty District, Art and Theater Cultural Specialty District pursuant to Chapter 4, or historic districts designated pursuant to Chapter 23 of the City Code that are located in a T-5 or less restrictive zoning transect, the City Manager, or his/her designee, may permit one District Marker Sign of not greater than 5,000 square feet in size nor greater than 80% of the area of a building wall oriented to face major traffic thoroughfares that serve as the entrance to the district. Each District Marker Sign shall be comprised solely of "Welcome to [the district]," and a commercial message related to the unique character of the district and recognizing the District Marker Sign sponsor, whose commercial message shall be limited to no more than 15% of the area of the District Marker Sign. The "Welcome to [the district]" portion of the District Marker Sign shall not contain any point of sale signage or commercial message related to the donor or sponsor. District Marker Signs as set forth in this paragraph shall be exempt from the general provisions of chapter 62, but for uniformity, all District Marker Signs are subject to compliance with County, State and Federal laws. No District Marker Sign shall contain adult content as defined in the Miami 21 zoning ordinance. *1f Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof. Footnotes: {1} Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. {2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10) days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
