HomeMy WebLinkAboutR-15-0207City of Miami Legislation Resolution: R-15-0207 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 15-00657 Final Action Date: 5/14/2015 A RESOLUTION OF THE MIAMI CITY COMMISSION APPROVING THE RETENTION OF THE CORAL GABLES CITYATTORNEY'S OFFICE, AS OUTSIDE CONFLICT COUNSEL, PRO BONO, FOR THE REPRESENTATION OF THE CITY OF MIAMI HISTORIC PRESERVATION OFFICE, HISTORIC AND ENVIRONMENTAL PRESERVATION BOARD, PLANNING AND ZONING DEPARTMENT STAFF AND OTHER CITY OF MIAMI ADMINISTRATORS, ON AN AS -NEEDED BASIS, ON LEGAL MATTERS IN CONNECTION WITH THE APPEAL OF THE APPROVAL OF A SPECIAL CERTIFICATE OF APPROPRIATENESS FOR SITE IMPROVEMENTS AT 3501 RICKENBACKER CAUSEWAY, FILED BY THE VILLAGE OF KEY BISCAYNE. WHEREAS, the City of Miami ("City") is the owner of the Miami Marine Stadium, also known as the Ralph Munroe Marine Stadium ("Miami Marine Stadium"), located at 3501 Rickenbacker Causeway, Miami, Florida; and WHEREAS, the City applied for a Special Certificate of Appropriateness for Site Improvements for the Miami Marine Stadium; and WHEREAS, the Historic and Environmental Preservation Board ("HEPB") approved the Special Certificate of Appropriateness on April 10, 2015; and WHEREAS, the Village of Key Biscayne appealed the approval of the Special Certificate of Appropriateness, which is set to be heard by the City Commission on May 14, 2015; and WHEREAS, the Office of the City Attorney advises the HEPB, the City Commission, and City staff on legal and procedural matters; and WHEREAS, the appeal to the City Commission is a quasi-judicial hearing at which the decisions and opinions of the City's Preservation Office, the HEPB, the Planning and Zoning Department Director, and City Administrators could conflict or be at odds with decisions and opinions of the City Commission relative to this matter and the Office of the City Attorney wishes to avoid any possibility of a conflict arising in its legal representation; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The retention of the Coral Gables City Attorney's Office, as outside conflict counsel, pro bono, for the representation of the Preservation Office, the HEPB, the Planning and Zoning City of Miami Page 1 of 2 File Id: 15-00657 (Version: 1) Printed On: 2/27/2018 File Number: 15-00657 Enactment Number: R-15-0207 Director, and City Administrators, on an as -needed basis, on legal matters in connection with the appeal of the Special Certificate of Appropriateness for Site Improvements at 3501 Rickenbacker Causeway filed by the Village of Key Biscayne, is approved. Section 3. This Resolution shall become effective immediately upon its adoption and signature of Mayor.{1} Footnotes: {1} Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. {2} This Resolution shall become effective as specified herein unless vetoed by the Mayor within ten (10) days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
