RESOLUTION NO, 9 4 - 755
A RESOLUTION RESCINDING IN THEIR ENTIRETY
RESOLUTION NO. 89-184, AS AMENDED. AND
RESOLUTION NO. 94-90; AND SUBSTITUTING IN
LIEU THEREOF A NEW RESOLUTION ESTABLISHING
CRITERIA AND PROCEDURES FOR NEWSPAPERS WHICH
CITY DEPARTMENTS AND OFFICER ARE PERMITTED TO

LISTING THE NAMES O1 THE ONLY NEWSPAPERS
APPROVED FOR SAID USE,
WHEREAS. notion 82-817, adopted July 22, 1982, established
oerta,iu oriteria for newspapers whJ.oh City departments and
olfioea were permitted to use for pubi1shiug publ.io notices and
further listed the names of certain newspapers to be added to an
existing list of newspapers used for such notioes; and
WHEREAS, Resolution No. 89--284, adopted February 9, 1989,
listed the names of the only newspapers which City departments
and offioea are permuted to use for publishing pt2l.io notioes;
and
WHEREAS.. Resolution No. 89-184 was amended by Resolution
No. 94-90, to reflect additione, deletions, or ohanges to the
list of newspapers approved; and
WHEREAS, oertain other changes and/or deletions neoeecitate
the reoessian of Resolution No. 89 -1a34 and Resolution No. 94-90,
and require that the City Commission adopt a new resolution
establishing criteria, prooedures, and listing the names of
newspapers to be used for przblio notices;

NOW, TREREF0RE, BE IT it}$OLVSD BY THE COMMISSION OF THE CITY
OF MIAMT. FLORIDA:
seotion 1. The reoitale and findings oontais ed in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2, Resol.utton No. 89-154, as amended, and
Resolution No. 94-90 are hereby rescinded in their entirety.
8eotion 3. The following criteria and procedures are
hereby established for newspapers to be used for publishing
public notices:
1. The newspapers must be well eetabliehed to the
oommuntty and have been in continuous operation
for several years.
2. The newspaper must have a oiroulation of over
10,00D.
8, The newspapers must be based in the City of Miami
with its primary oiroulation distributed within
City limits.
4, Any newspaper meeting the established criteria
that wishes to be i,no1uded to the list of
newspapers used for publishing pub1io notices may
notify the City Manager who will present said
request to the City Commission for ooneideration;
said newspaper shall present to the City a
oertified statement of oiroulation, In Lieu of
said oertified statement, a sworn statement as to
oiroulation average for the last year and
speotfiaaily for the past two editions will be
accepted.
5. Al]. newspapers approved by the City Commission
shall report to the City every six months the
amount of its last oi.reulation, said amount to be
confirmed by the seller of the newsprint.
B. Unless specifically designated that a newspaper be
used on an ongoing basis, newspapers approved by
the City Commiseioxr shall be used on a rotating
and equitable basis providing they meet the
established criteria.

Section 4. Effective October 28, 1904, all City
departments and offices are hereby instructed to use only the
following newspapers for publishing public notices, absent =I'
legal emergenoy requiring placement of suoi notices elsewhere,
such usage for placement of courtesy natives; i,e., those notices
which are not legally required to be advertised, are required to
be submitted to applicable publ.i.oations by City departments on a
rotational and equitable basis; all newspapers are hereby
required at 0.1 times to meet criteria and prooeduree established

A RESOLUTION AMENDING RESOLUTION NO. 94-755,
ADOPTED OCTOBER 27, 1994, WHICH RESOLUTION
ESTABLISHED CRITERIA AND PROCEDURES FOR
NEWSPAPERS WHICH CITY DEPARTMENTS AND OFFICES
ARE PERMITTED TO USE FOR PUBLISHING PUBLIC
NOTICES AND FURTHER LISTED THE NAMES OF THE
ONLY NEWSPAPERS APPROVED FOR SAID USE,
THEREBY ADDING "LA PRENSA DE MIAMI" TO SAID
LIST OF' NEWSPAPERS, CONDITIONED UPON
COMPLIANCE WITH ALL REQUIREMENTS THAT MAY BE
IMPOSED BY THE PLORIDA STATUTES AND ALL
APPLICABLE CITY CHARTER AND CODE PROVISIONS.
WHEREAS, Resolution No. 94-755, adopted October 27, 1994,
established certain criteria for newspapers which City
departments and offices are permitted to use for publishing
public notices and further listed the names of certain newspapers
to be used for such notices; and
WHEREAS, Motion No. 94-773, adopted by the City Commission
on October 27, 1994, instructed that "La Prensa de Miami" be
included amongst the designated newspapers to be used by the City
for publishing of public notices, subject to said newspaper
complying with the City t s eligibility requirements; and

WHEREAS, the Procurement Division of the Department of
General Services Administration/Solid Waste has reviewed the
appliCatJ.on of "La Prensa de Miami" and has ascertained that said
newspaper meets the criteria established by the City of Miami for
public notice advertisements; and
WHEREAS, it is necessary to amend Resolution No. 94•-755 to
reflect the inclusion of "La Prensa de Miami" as a newspaper to
be used by City departments to advertise public notices;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Resolution No. 94-755, adopted October 27,
1994, is hereby amended in the following particulars:I/
