HomeMy WebLinkAboutCRA Pre-LegislationCity of Miami Legislation CRA Resolution: CRA-R-14-0069 City Hall 3500 Pan American Drive Miami, FL 33133 www.mlamigov.com File Number: 14-01037 Final Action Date: 12/29/2014 A RESOLUTION OF THE BOARD OF COMMISSIONERS OF THE SOUTHEAST OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT AGENCY AUTHORIZING THE ISSUANCE OF A GRANT, IN AN AMOUNT NOT TO EXCEED $275,000, TO THE CITY OF MIAMI FORA POLICE CAMERA PILOT PROGRAM WITHIN THE REDEVELOPMENT AREA; AUTHORIZING THE EXECUTIVE DIRECTOR TO DISBURSE FUNDS, AT HIS DISCRETION, ON A REIMBURSEMENT BASIS OR DIRECTLY TO VENDORS, UPON PRESENTATION OF INVOICES AND SATISFACTORY DOCUMENTATION; FURTHER AUTHORIZING THE EXECUTIVE DIRECTOR TO EXECUTE ALL DOCUMENTS NECESSARY FOR SAID PURPOSE; ALLOCATING FUNDS FROM SEOPW, "OTHER GRANTS AND AIDS," ACCOUNT CODE NO. 10050.920101.883000.0000.00000. WHEREAS, the Southeast Overtown/Park West Community Redevelopment Agency ("CRA") is a community redevelopment agency created pursuant to Chapter 163, Florida Statutes, and is responsible for carrying out community redevelopment activities and projects within its Redevelopment Area in accordance with the 2009 Southeast Overtown/Park West Redevelopment Plan ("Plan"); and WHEREAS, Section 2, Goal 6, at page 11, of the Plan lists the " [i]mproving quality of life for residents of the Redevelopment Area", as a stated redevelopment goal; and WHEREAS, Section 2, Principle 5, at page 14, of the Plan provides that "[w]alking within the neighborhood must be accessible, safe, and pleasant" as a stated redevelopment principal; and WHEREAS, given the increased level of violence throughout the Redevelopment Area, the City of Miami Police Department seeks to implement a Police Camera Pilot Program ("Pilot Program"); and WHEREAS, the nature of the services to be rendered by the Pilot Program consists of the installation and operation of closed circuit television cameras throughout the Redevelopment Area ; and WHEREAS, the implementation of the Pilot Program is meant to improve public safety by providing enhanced policing services with the ability to instantly monitor and/or record video images in an effort to prevent crime, conduct investigations, or apprehend individuals committing crimes; and WHEREAS, the Board of Commissioners wishes to authorize the issuance of a grant, in an amount not to exceed $275,000, to the City of Miami to underwrite costs associated with the installation and operation of the Pilot Program throughout the Redevelopment Area ; and WHEREAS, the Board of Commissioners finds that the adoption of this Resolution would further the aforementioned redevelopment goal and objective; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE SOUTHEAST OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT AGENCY OF THE CITY City of Miami Page 1 of 2 File Id: 14-01037 (Version: 1) Printed On; 1/6/2015 File Number: 14-01037 Enactment Number: CRA-R-14-0069 OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. The Board of Commissioners hereby authorizes the issuance of a grant, in an amount not to exceed $275,000, to the City of Miami to underwrite costs associated with the installation and operation of the Police Camera Pilot Program throughout the Redevelopment Area . Section 3. The Executive Director is authorized to disburse funds, at his discretion, on a reimbursement basis or directly to vendors, upon presentation of invoices and satisfactory documentation. Section 4. The Executive Director is authorized to execute all documents necessary for said purpose. Section 5. Funds are to be allocated from SEOPW Tax Increment Fund, entitled "Other Grants and Aids," Account Code No. 10050.920101.883000.0000.00000. Section 6. This Resolution shall become effective immediately upon its adoption. WHEREAS, the Southeast Overtown/Park West Community Redevelopment Agency ("CRA") is a community redevelopment agency created pursuant to Chapter 163, Florida Statutes, and is responsible for carrying out community redevelopment activities and projects within its Redevelopment Area in accordance with the 2009 Southeast Overtown/Park West Redevelopment Plan ("Plan"); and WHEREAS, Section 163.335, Florida Statutes, states that the existence of slum and blighted areas greatly contributes to the spread of disease and crime causing economic and social burdens to the community, thereby negatively affecting the tax base and impairing sound growth within the community; and WHEREAS, in response to the existence of slum and blight within the State of Florida, Section 163.356, Florida Statutes allows for the creation of community redevelopment agencies to address these conditions by engaging in "community redevelopment;" and WHEREAS, Section 163.340(9), Florida Statutes, defines "community redevelopment" in part as "undertakings, activities, or projects of a ... community redevelopment agency in a community redevelopment area ... for the reduction or prevention of crime;" and WHEREAS, Section 163.340(23), Florida Statutes provides a means for community redevelopment agencies to address crime through "community policing innovations" which is defined as "policing technique or strategy designed to reduce crime by reducing opportunities for, and increasing the perceived risks of engaging in, criminal activity through visible presence of police in the community, including, but not limited to, community mobilization, neighborhood block watch, citizen patrol, citizen contact patrol, foot patrol, neighborhood storefront police stations, field interrogation, or intensified motorized patrol;" and WHEREAS, Section 163.387(1)(a), Florida Statutes, states that redevelopment trust funds "shall be used by the agency to finance or refinance any community redevelopment it undertakes City of Miami Page 1 of 3 File Id: 15-00332 (Version 1) Printed On: 4/6/2015 File Number: 15-00332 Enactment Number.• CRA-R-15-0011 pursuant to the approved community redevelopment plan;" and WHEREAS, Section 163.387(6)(h), Florida Statutes, states "[m]oneys in the redevelopment trust fund may be expended from time to time for undertakings of a community redevelopment agency as described in the community redevelopment plan for ... [t]he development of 'community policing innovations';" and WHEREAS, the Plan at page 128, states that the CRA shall be empowered "to establish, implement, and fund community policing innovations" and has incorporated therein the statutory definition of community policing innovations, stated above, at page 135 of the Plan; and WHEREAS, Section 2, Goal 6, at page 11, of the Plan lists the "[i]mproving quality of life for residents of the Redevelopment Area", as a stated redevelopment goal; and WHEREAS, Section 2, Principle 5, at page 14, of the Plan provides that "[w]alking within the neighborhood must be accessible, safe, and pleasant" as a stated redevelopment principal; and WHEREAS, Section 2, Principle 1, at Page 14 of the Plan states that "walkability" is "a key component of the vibrant and healthy neighborhood;" and WHEREAS, given the increased level of violence throughout the Redevelopment Area , the City of Miami Police Department seeks to implement a Police Pilot Program within the Redevelopment Area ("Pilot Program"); and WHEREAS, the nature of the services to be rendered by the Pilot Program consists of police services to enhance the general patrol within the Redevelopment Area for the purpose of providing enhanced police support to the area; and WHEREAS, the implementation of this Pilot Program is meant to improve public safety by providing enhanced policing services, including, but not limited to, foot patrol, field interrogation, and intensified motorized patrol; and WHEREAS, the Board of Commissioners, by Resolution No. CRA-R-14-0069, passed and adopted on December 29, 2014, authorized a grant, in an amount not to exceed $275,000, installation of nine (9) closed-circuit television cameras within the Redevelopment Area, for the purposes of allowing the City of Miami Police Department to instantly monitor and/or record video images to prevent crime and conduct investigations within the area as part of the Pilot Program; and WHEREAS, the Board of Commissioners wishes to authorize a grant, in an amount not to exceed $700,000 (initially budgeted for $1,025,000 for fiscal year beginning October 1, 2014 through September 30, 2015), to the City of Miami to underwrite costs associated with a Police Pilot Program within the Redevelopment Area; and WHEREAS, the Board of Commissioners finds that the adoption of this Resolution would further the aforementioned redevelopment objectives; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE SOUTHEAST OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 2 of 3 File Id: 15-00332 (Version: 1) Printed On: 4/6/2015 File Number: 15-00332 Enactment Number: CRA-R-I5-0011 Section 1.
