AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER
62/ARTICLE XIII OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED,
ENTITLED "PLANNING AND ZONING APPROVAL FOR TEMPORARY USES AND
OCCUPANCIES; PERMIT REQUIRED," TO CREATE A NEW DIVISION 11
ENTITLED "DISTRICT MARKERS" TO PROVIDE FOR SIGNS MARKING THE
ENTRANCE TO AREAS OF SPECIAL INTEREST AND UNIQUE CHARACTER;
CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, District Markers highlight the entrance to areas of special interest and unique
character for visitors, and reinforce the neighborhood's character as a destination for art, culture,
dining, and entertainment; and
WHEREAS, the City of Miami desires to permit District Markers subject to certain requirements.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by
reference and incorporated as fully set forth in this Section.
Section 2. Chapter 62 of the Code of the City of Miami, Florida, as amended, entitled "PLANNING
AND ZONING," is amended in the following particulars:{1}

OCCUPANCIES; PERMIT REQUIRED
DIVISION 11. DISTRICT MARKERS

District: For purposes of these regulations, a district is a specific area of special interest and unique
character as set forth in Section 62-642 which has an established regional presence as a commercial
destination.
District Marker: A Large-scale, mounted identity display that serves to identify the district, mark a
destination for visitors, and reinforce the district's character as a destination. A District Marker shall be
less than 5,000 square feet in size or 80% of a Building wall, and may be comprised solely of an art
installation and recognition of the installation sponsor, which sponsor or donor recognition shall be
limited to one (1) recognition comprising no more than 15% of the art installation. Art installations
forming part of a District Marker shall not contain any adult content, point of sale signage, or
commercial message related to the donor or sponsor.
Sec. 62-642, Districts.
a. Little Havana Art and Theater Cultural Specialty District ("cultural specialty district"): An area
comprised of those properties fronting the Southwest 8th Street corridor from Southwest 10th
to Southwest 27th Avenues.
Sec. 62-643. Location within Districts.
a. District Markers shall be oriented to face major traffic thoroughfares, within the District area.
b. District Markers shall be located on or near major entry points to Districts and implemented so
as to reinforce a sense of arrival to the District.
c. District Markers shall not be located within 300 feet of a T3, T4-R, T5-R or T6-R zone and
shall be illuminated only as specifically authorized by the regulations for the Transect in which
erected. Illumination shall be calibrated according to the standards applicable in the most
restrictive zoning designation from which the District Marker is directly visible.
Sec. 62-644. Permitting.
a. A comprehensive study of the District shall be conducted by the Planning and Zoning
Department to identify the major entry points to the District and surrounding buildings thereto
which may be well suited for the implementation of District Markers. The characteristics and
configuration of the buildings and structures surrounding a District's entry points shall be
considered in the study.
b. District Markers may be permitted by Warrant process pursuant to the criteria and regulations
for said process set forth in Miami 21, the Zoning Ordinance of the City of Miami and further
subject to the limitations set forth herein.
c. All District Markers must comply with State and Federal law, and Chapter 33 Article 6 of the
Miami Dade County Code.

Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is
declared invalid, the remaining provisions of this Ordinance shall not be affected.

Section 4. This Ordinance shall become effective thirty (30) days after final reading and adoption
thereof.

{2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within
ten (10) days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall
become effective immediately upon override of the veto by the City Commission or upon the
effective date stated herein, whichever is later.
