Our client, 444 Brickell Partners LLC TRS 444 Brickell Land Trust, is the owner of the
property located at approximately 444 Brickell Avenue and 77 SE 5 Street, Miami, Florida. The
property currently has two existing office structures with ground floor retail and restaurant uses, along
with applicable parking. The site is going to be redeveloped in two phases. As part of the
redevelopment, the new proposed site plan proposes Riverwalk improvements which will link the
properties to the East and West of our site. The project is proposed with 51,846 square feet of ground
floor retail, 41,139 office, 1400 residential units, 125 lodging units and 1993 parking space (the
"Project"). We are processing a Waiver application which will require the below described Waivers.
GUIDING PRINCIPALS: The Guiding Principals in support of all the Waivers described below are
as follows:
Section 2.1.3.1. The City:
a. Growth strategies should encourage Infill and redevelopment.
-- The proposed project is an infill project located in the Downtown Brickell Core at
NE 5th Street and Brickell Avenue.
b. New Development should be structured to reinforce a pattern of Neighborhoods and
urban centers focusing growth at transit nodes rather than along Corridors.
-- The Project is proposed as urban center mixed use project providing for a variety
of uses, with a lined garage and vehicle entries from a Secondary Frontage. The
Project accomplishes being a traffic node as along Brickell Avenue there are two
Bus Routes.
c. The City should include a framework of transit, pedestrian, and bicycle systems that
provide alternatives to automobile use.
-- The Project includes vehicular and bicycle parking options, as well as a
Pedestrian Cross Block Passageway in a North/South direction. Furthermore, the
Project contains a Pedestrian Waterfront Riverwalk connecting the eastern side
under Brickell Avenue to the western side of Brickell.

a. Neighborhoods and urban centers should be the preferred pattern of Development and
Transect Zones emphasizing single use should be the exception.
-- The Project is proposed as urban center mixed use project providing for Hotel,
Residential, retail and restaurant uses.
b. Neighborhoods and Urban centers should be compact, pedestrian -oriented and
Mixed -Use. Density and Intensity of Use should relate to degree of transit service.
-- The Project is compact with a variety of uses and located in the Downtown
Brickell Core. The Project includes an expansive Riverwalk.
c. The ordinary activities of daily living should occur within walking distance of most
dwellings, allowing independence to those who do not drive.
-- The Project is centrally located in the Downtown Brickell core with easy access
across the Bridge to the Central Business District and within walking distance
Brickell CitiCenter and Mary Brickell Village. Therefore, there are several locations
which can be reached within a walking distance of the site.
d. Interconnected networks of Thoroughfares should be designed to disperse and reduce
the length of automobile trips and to encourage walking and bicycling.
-- The Project is located along a principal Thoroughfare, Brickell Avenue with
alternative access heading west on NE 5th Street. Furthermore, because of its central
location there are various walking and bicycle path options surrounding the site.
e. Appropriate building Densities and land uses should occur within walking distance of
transit stops.
-- The property is less than 200 feet from a Metromover station and abutting
Brickell which has two Bus Stops close by.
f. Within Neighborhoods, a range of housing types and price levels should
accommodate diverse ages and incomes.
-- The Project proposes to have Hotel/Lodging Use and Residential Condominium,
at various price ranges.
Section 2.1.3.3 The Block and the Building - Guiding Principles
a. Buildings and landscaping should contribute to the physical definition of
Thoroughfares as civic places.
-- The Project complies with the required Open Space in Miami 21. The Project
complies with a 50 foot Waterfront Setback, as well as the two Side View Corridors
which account for 25% of the side lot width with minimal encroachments above.
b. Development should adequately accommodate vehicles while respecting the
pedestrian and the spatial form of public space.
-- The Project has lined the parking garage along both the Waterfront Frontage,
Brickell. Frontage and the majority of the Secondary Frontages along NE 5th Street.
c. Architecture and landscape design should grow from local climate, topography,
history, and building practice.
-- The Landscape plan incorporates native trees into the proposed landscaping plan.
The existing site is predominantly covered in asphalt and/or concrete.

d. Buildings should allow their inhabitants to experience the geography and climate
through energy efficient design.
-- The Project is being proposed as a LEED Silver project or equivalent FGBC
certification.
LIST OF ZONING WAIVERS:
1. Waiver requested pursuant to Miami 21, pursuant to Article 7, Section 7.1.2.5 (28) for
additional 10% for building length for Tower 3 only.
The requested Waiver has practical difficulty in otherwise meeting the standards of the
Transect Zone T6-48 Floorplate length of 180 feet for residential uses in Tower 3 which Fronts on
Brickell Avenue because of the irregular curvature of the property line on Brickell Avenue and unique
architectural design of the tower require the expanded length from 180 to 198 feet. Please note that
Commercial Uses are otherwise allowed a Floorplate length of 215 feet.
2. Waiver requested pursuant to in Article 4, Table 4, to allow parking reduction up to 30
percent (30%) of required parking when the property is located with 1/2 mile radius of TOD or with
1/4 mile radius of a Transit Corridor.
The requested Waiver promotes energy conservation and Building sustainability by reducing
the impacts from automobile use and encourages the use of public transportation. Parkings reductions
are designed to increase the pedestrian orientation of projects and minimize the adverse environmental
effects of parking facilities. Furthermore, parking reductions help reduce public health risks by
encouraging daily physical activity associated with walking and bicycling.
LIST OF CHARTER WAIVER:
A Special Appearance Application is requested as identified in City Code Section 3 mm ii (a)
for the Waiver of the Waterfront side yard setback of 25% of the Lot Width along the waterfront
Frontage to allow encroachments above.
The Project has a waterfront length of 384 feet along the Miami River. As such, the
corresponding View Corridor of 25% is 96 feet. The Project provides 30 feet along the western edge
and 66 feet along the eastern edge at the ground level. The Charter Waiver is being requested in order
to allow the Building's Eastern Facade to encroach no more than 22'-8" feet at the deepest point at a
minimum height of 34'-0" feet above, however all times maintaining at the Ground Level a 66 foot
wide open area in compliance with the View Corridor.

The responses to this application must be typed and signed in black ink. All pertinent and
accurate information/documentation; i.e., the plans, reports, exhibits, shall be presented at the
time of filing, in addition to the paid receipt. The applicant is responsible for the accuracy of the
information contained in the application and all supporting materials. Should you wish, you
could bring the materials to our office for review prior to submittal to ensure completeness.
You will be responsible, if needed, to bring an interpreter for the English language to any
presentation before city boards, committees and the city commission. A valid power of attorney
will be required if neither applicant or legal counsel representing the applicant execute the
application or desire to make a presentation before city boards, committees and the city

Pursuant to the Miami City Charter Section 3mm iii and the Miami 21 Code Article 3 Section 3.11 this proposal
for "One Brickell", a Mixed -Use development, located at 444 Brickell Avenue, Miami, Florida 33131 requires
a Special Appearance Application. Proposal seeks a modification to allow an encroachment of the aggregate
side -yard (View Corridor) requirement, which is subject to CITY COMMISSION APPROVAL.
The proposed waterfront mixed -use development is made up of Hotel, Residential, Office, and Commercial
Uses. Development proposes 1,400 Residential Units, 249 Lodging Units, 24,463 square feet of Commercial
Area, and 41,272 square feet of Office Area. Proposed Building consists of three (3) towers sitting on top of a
single eight (8) story Podium. Tower I proposes 75 Stories with 674 feet of Elevation Height. Tower II proposes
55 Stories with 481 feet of Elevation Height. Tower III proposes 80 Stories with 859 feet of Elevation Height.
Total FLR is 3,413,636 square feet, which includes 868,399 square feet of Bonus FLR.
REQUEST to the City Commission pursuant to City Charter Section 3(mm)(iii) for a modification to the
waterfront side -yard (view corridor) requirement.
