HomeMy WebLinkAboutR-15-0200City of Miami Legislation Resolution: R-15-0200 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 15-00552 Final Action Date: 4/23/2015 A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE DEPARTMENT OF PLANNING AND ZONING TO STUDY ARTICLE 3, SECTION 3.14 ENTITLED "PUBLIC BENEFITS PROGRAM" OF ORDINANCE NO. 13114, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FOR POTENTIAL AMENDMENTS, TO CREATE A MIAMI-DADE COUNTY SCHOOL BOARD FUND PUBLIC BENEFITS PROGRAM ("SCHOOL FUND") FOR DEVELOPMENTS IN THE BRICKELL INCREASED DENSITY AREA ("AREA") TO ALLOW FOR PUBLIC BENEFITS CONTRIBUTIONS INTO THE SCHOOL FUND TO ASSIST WITH INCREASED STUDENT CAPACITYAMPLICATION IN THE BRICKELL CORE AREA. WHEREAS, Article 3, Section 3.14 entitled "Public Benefits Program" of Ordinance No. 13114, the zoning ordinance of the City of Miami (hereinafter "City") currently allows bonus Building Height and Floor Lot Ratio (hereinafter "FLR") in T6 Zones in exchange for the developer's contribution to specified programs that provide benefits to the public; and WHEREAS, Article 3, Section 3.14 currently has two (2) funding sources, the Affordable Housing Trust Fund and the Open Space Trust Fund; and WHEREAS, there is a need in the Brickell Area to increase student seats and capacity amplification; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Commission directs the Department of Planning and Zoning to study Article 3, Section 3.14 entitled "Public Benefits Program" of Ordinance No. 13114, the Zoning Ordinance of the City for potential amendments, to create a Miami -Dade County School Board Fund Public Benefits Program ("School Fund") for developments in the Brickell Increased Density Area ("Area") to allow for public benefits contributions into the School Fund to assist with increased student capacity amplication in the Brickell Core Area. Section 3. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
