File Number: 15-00395 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ACCEPTING THE PLAT ENTITLED "GARDEN PARK ON THE BAY" ("PLAT"), A REPLAT IN THE CITY OF MIAMI OF THE PROPERTY DESCRIBED IN "ATTACHMENT 1" ("PROPERTY"), SUBJECT TO THE SATISFACTION OF ALL CONDITIONS REQUIRED BY THE PLAT AND STREET COMMITTEE AS SET FORTH IN "EXHIBIT A," ATTACHED AND INCORPORATED, THE RECORDATION OF A SPECIAL WARRANTY DEED, AS DESCRIBED IN "ATTACHMENT 2," ATTACHED AND INCORPORATED, TO CONVEY THE PROPERTY PRIOR TO RECORDATION OF THE PLAT, AND THE PROVISIONS CONTAINED IN SECTION 55-8 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; ACCEPTING THE DEDICATIONS SHOWN ON THE PLAT, WITH THE APPLICANT; AUTHORIZING AND DIRECTING THE CITY MANAGER AND CITY CLERK TO EXECUTE THE PLAT; AND PROVIDING FOR THE RECORDATION OF THE PLAT IN THE PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA. WHEREAS, the Plat and Street Committee ("Committee"), established pursuant to Chapter 55 of the Code of the City of Miami, Florida, as amended ("City Code"), at its meeting of November 7, 2013, reviewed this proposed plat entitled "GARDEN PARK ON THE BAY" ("Plat"), and determined that all technical requirements have been met; and WHEREAS, the Committee recommends the acceptance of the Plat; and WHEREAS, the applicant has agreed to dedicate to the City land adjacent to the grantor's property to be solely used and enjoyed as a park, and has agreed to maintain said property in perpetuity; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The Plat entitled, a replat of the property described in "Attachment 1," which Plat by reference, in substantially the attached form, and subject to satisfaction of all conditions required by the Committee as set forth as "Exhibit A," attached and incorporated, and the provisions contained in Section 55-8 of the City Code, is accepted. The dedications shown on the Plat, together with the dedications to the perpetual use of the public of all existing and future planting, trees, and shrubbery on said property, are also accepted and confirmed by the City of Miami, Florida. Section 3. The City Manager is authorized to sign{1} the Plat as owner of a portion of the property. Section 4. Prior to recordation of the Plat, issuance of a Temporary Certificate of Occupancy, or issuance of a Certificate of Occupancy, whichever occurs first, the applicant shall record a covenant on the property, in a form acceptable to the City Attorney, that satisfies the conditions set forth in City of Miami Page 1 of 2 File Id: 15-00395 (Version: 1) Printed On: 4/14/2015 File Number: 15-00395 Exhibit A-1 to City Commission Resolution No. 12-0289, adopted July 26, 2012. Section 5. Prior to the recordation of the Plat, issuance of a Temporary Certificate of Occupancy, or issuance of a Certificate of Occupancy, whichever occurs first, the Applicant shall record a Special Warranty Deed to convey the park, as depicted in "Attachment 2," in substantially the attached form. Section 6. The City Manager and City Clerk are authorized {1} and directed to execute the plat, and cause the same to be recorded in the Public Records of Miami -Dade County, Florida. Section 7. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} APPROVED AS -TO FORM AND CORRECTNESS: TORIA DE-2— CITY RNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} if the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
