Background Information:
An ordinance of the Miami City Commission amending chapter 42/article IV of the Code of the City
of Miami, Florida, as amended ("City Code"), entitled "Towing and Immobilization of Motor
Vehicles," more particularly by repealing sections 42-110 and 42-119 in their entirety and replacing
them with new section 42-110 adopting the maximum towing rates as established by Miami -Dade
County for the recovering, towing, removing and storing of motor vehicles; containing a repealer
provision, a severability clause and providing for an immediate effective date.

On July 13, 2006, the City Commission adopted Ordinance 12828, which amended Chapter 42, Article IV,
Division 4, Section 42-119 of the City Code by adjusting the maximum tow rates allowed for the Police
Department and the Department for Off -Street Parking dispatched towing and wrecker service for private
vehicles. Additionally on February 11, 2010, the City Commission adopted Ordinance 13142, which authorized
an increase in the towing rates as set forth in 2006 under Section 42-119; as Division 3, Section 42-117, which
had not been increased since 2000. Despite the fact that the rates increased pursuant to Ordinance 13142, the
increase was negligible; i.e., a Class A tow was increased from $50.00 to $52.50.
The City's towing rates have been in place for five years and are less than Miami -Dade County's maximum rates.
During these five years, the tow companies have experienced increases in labor costs due to minimum wage
increases, increased cost of insurance and increase cost associated with the administrative oversight by the City.
Pursuant to Florida Statute 125.0103(1)(c), counties must establish the maximum rates which may be charged
on the towing of vehicles from or immobilization of vehicles on private property, removal and storage of
wrecked or disabled vehicles from an accident scene or for the removal and storage of vehicles. The adoption
of the maximum towing rates as established by Miami -Dade County will bring the City's towing rates to industry
standards.
