Hannon, City Clerk FROM: Victoria Mendez, City Attorney DATE: May 28, 2015 RE: Scrivener's Error — Resolution No. 15-0168, adopted April 9, 2015, regarding amending provisions in Chapter 339 of the Florida Statutes File ID 15-00434 A scrivener's error appears in Resolution No. 15-0168, adopted April 9, 2015, in the inadvertent omission of a directive of the City Commission, directing the City of Miami Clerk's Office to send copies of the Resolution to the members of the Florida State Legislature, Governor Rick Scott, as well as the Miami -Dade County Metropolitan Planning Organization. When adopted by the City Commission, this language was not included as Section 4 of the Resolution. The inadvertent omission has been remedied, the necessary language included, and the Resolution finalized. VM Enclosure(s) (177 Cji ur V�� ‘r" 5 E rn0 City of Miami Legislation Resolution: R-15-0168 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 15-00434 Final Action Date: 4/9/2015 A RESOLUTION OF THE MIAMI CITY COMMISSION URGING GOVERNOR RICK SCOTT AND THE MEMBERS OF THE FLORIDA LEGISLATURE TO AMEND THE PROVISIONS IN CHAPTER 339 OF THE FLORIDA STATUTES TO REDUCE THE NUMBER OF VOTING MEMBERS ON METROPOLITAN PLANNING ORGANIZATIONS ("MPOS") OR, ALTERNATIVELY, TO MAKE THE MIAMI-DADE MPO MORE EFFICIENT BY ANY OTHER EFFECTIVE MEANS AS MAY BE PROPOSED BY THE MEMBERS OF THE MIAMI-DADE MPO; ADDING THIS ISSUE TO THE CITY OF MIAMI'S LEGISLATIVE PRIORITIES FOR 2015; DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE OFFICIALS STATED HEREIN. WHEREAS, the federal government has established Metropolitan Planning Organizations ("MPOs") to ensure transportation planning compliance in urbanized areas such as Miami -Dade County; and WHEREAS, in addition, the Florida Legislature, in Chapter 339 of the Florida Statutes, has established requirements for MPOs to develop plans and programs that will encourage and promote the safe and efficient management, operation, and development of surface transportation systems that will serve the mobility needs of people and freight and foster economic growth and development within and throughout urbanized areas of the State of Florida; and WHEREAS, pursuant to Section 339.175 of the Florida Statutes, the voting membership of an MPO may consist of up to 25 appointed members; and WHEREAS, the Governing Board of the Miami -Dade MPO is currently comprised of 13 Miami -Dade County Commissioners, a Miami -Dade Expressway representative appointed by the Governor, a Miami -Dade County School Board Representative appointed by the Governor, an elected official from each of the six (6) municipalities in Miami -Dade County with a population over 50,000, a representative from a municipality appointed by the Governor, one (1) non -elected public official residing in unincorporated Miami -Dade County appointed by the Governor, and two (2) non -voting members from the Florida Department of Transportation; and WHEREAS, in recent years the voting membership of the MPO has increased from up to 19 apportioned members to up to 25 apportioned members; and WHEREAS, in order to function more efficiently and effectively, the membership of MPOs in the State of Florida should either be reduced or, alternatively, made more efficient by any other effective means proposed by the various members of the Miami -Dade MPO; and WHEREAS, this issue should be added to the City of Miami's Legislative priorities for 2015; City of Miami Page 1 of 2 File Id: 15-00434 (Version: 2) Printed On: 5/28/2015 File Number: 15-00434 Enactment Number: R-I5-0168 NOW, THEREFORE, BE IT BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings found in the preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The Miami City Commission urges Governor Rick Scott and the members of the Florida Legislature to amend the provisions of Chapter 339 of the Florida Statutes to reduce the number of voting members on MPOs or, alternatively, to make the Miami -Dade MPO more efficient by any other effective means as may be proposed by the members of the Miami -Dade MPO. Section 3. The Miami City Commission hereby adds this issue to the City of Miami's Legislative priorities for 2015. Section 4. The City Clerk is directed to transmit a copy of this resolution to Florida Governor Rick Scott, the members of the Florida State Legislature, and to the members of the Miami -Dade County Metropolitan Planning Organization. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1} APPROVED AS TO FORM AND CORRECTNESS: VI ORIA M NDEZ. CITY ATTORNEY Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
