Purpose of Item: A Resolution of the Miami City Commission, with attachment(s), declaring surplus and authorizing the City Manager to execute a Quit Claim Deed, conveying to the State of Florida, Department of Transportation (FDOT), at no cost, 139 square feet of City -owned land located at 1338 NW 2 Avenue ("Property"), Miami, Florida. Further authorizing the City Manager to execute all documents that may be necessary to consummate such conveyance, which terms may be amended by the City Manager as may be necessary in order to meet the best interest of the City. Director ' " City Manage Page 1 of 2 SUPPLEMENTAL PAGE Subject: Resolution for the conveyance of the City owned CLUC 90 property located at 1338 NW 2 Avenue, to the Florida Department of Transportation (FDOT). Background Information: The State of Florida Department of Transportation ("FDOT") proposes to construct or improve State Road No. 836 (I-395), Item No. 251688-1, in Miami Dade County, Florida. It is necessary that certain land now owned by the City of Miami ("CITY") be acquired by the State of Florida Department of Transportation. Currently the property sits vacant, represents a maintenance cost and liability to the City. Section 29-B of the City of Miami Charter allows for the conveyance or disposition of City -owned property in connection with the implementation of projects of any governmental agency or instrumentality without being subject to competitive bidding requirements or fair market value return to the City. It is necessary that the parcel now owned by the City of Miami and not needed for City purposes, be conveyed to FDOT to enable the construction and improvements by FDOT of the 1-395, in order to serve the best interest of the general welfare of the City of Miami and its inhabitants. The Property will be conveyed "as is" and "where is" and the City will not warrant the sufficiency of its title nor interest it may have in the property. Page 2 of 2
