HomeMy WebLinkAboutR-15-0164City of Miami Legislation Resolution: R-15-0164 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 15-00303 Final Action Date: 4/9/2015 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), DECLARING SURPLUS AND AUTHORIZING THE CITY MANAGER TO EXECUTE A QUIT CLAIM DEED, IN SUBSTANTIALLY THE ATTACHED FORM, CONVEYING, AT NO COST, TO THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION, 139 SQUARE FEET OF CITY OF MIAMI-OWNED LAND, LOCATED AT 1338 NORTHWEST 2 AVENUE, MIAMI, FLORIDA ("PROPERTY"), AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A," ATTACHED AND INCORPORATED; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ALL THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO CONSUMMATE SUCH CONVEYANCE, WHICH TERMS MAY BE AMENDED BY THE CITY MANAGER AS MAY BE NECESSARY IN ORDER TO MEET THE BEST INTEREST OF THE CITY. WHEREAS, the State of Florida Department of Transportation ("FDOT"), a state governmental agency, proposes to construct or improve State Road No. 836 ("1-395"), in Miami -Dade County, Florida ("Project"), which is a Project of FDOT and which serves a public purpose; and WHEREAS, it is necessary that certain land located at 1338 Northwest 2 Avenue, Miami, Florida ("Property"), now owned by the City of Miami ("City"), be acquired by FDOT for the Project; and WHEREAS, currently the Property sits vacant, representing a maintenance cost and liability to the City; and WHEREAS, Section 29-B(c) of the City Charter allows for the conveyance or disposition of City -owned property in connection with the implementation of projects of any governmental agency or instrumentality without being subject to competitive bidding requirements or fair market value return to the City; and WHEREAS, it is necessary that the Property now owned by the City, and not needed for City purposes, be conveyed to FDOT to enable the construction and improvements by FDOT of the Project, in order to serve the best interest of the general welfare of the City and its inhabitants; and WHEREAS, the Property will be conveyed "as is" and "where is," and the City will not warrant the sufficiency of its title nor any interest it may have in the Property; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated herein as fully set forth in this Section. The City Manager is authorized to execute a Quit Claim Deed, in substantially the attached form, conveying to FDOT, at no cost, 139 sq. ft. of land located at 1338 Northwest 2 Avenue, Miami, Florida. Section 3. The City Manager is authorized{1} to execute all documents necessary to effectuate said conveyance, in a form acceptable to the City Attorney, which terms may be amended by the City Manager as may be necessary in order to meet the best interest of the City. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
