AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER
62/ARTICLE XIII/DIVISION 9 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, ENTITLED "ZONING AND PLANNING/ZONING APPROVAL FOR
TEMPORARY USES AND OCCUPANCIES; PERMIT REQUIRED/FARMERS'
MARKET PILOT PROGRAM," MORE PARTICULARLY BY AMENDING SECTION
62-622 ENTITLED, "FARMER'S MARKET PILOT PROGRAM"; CONTAINING A
SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Florida Statute 163.3161 states that it is the duty of local government to "overcome
present handicaps, "such as threats to health, and to "preserve, promote, protect, and improve the
public health and safety"; and
WHEREAS, local food projects such as farmers' markets have shown to combat handicaps to
health while improving community economic vitality and environmental sustainability; and
WHEREAS, the City of Miami ("City") has an interest in promoting the availability of healthy and
locally -grown foods within its communities through a farmers' market program; and
WHEREAS, major cities across the nation have promulgated legislation and comprehensive plans
facilitating the proliferation of farmers' markets to maximize their benefits; and
WHEREAS, the City seeks to be a leader which protects and improves the health and well-being
of its residents and their environment; and
WHEREAS, current ordinances make it cost -prohibitive and difficult to operate farmers' markets
which are beneficial to the City's residents and their environment; and
WHEREAS, the current pilot programs and permits have expired and the programs have been
successful and positive for the communities;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. Chapter 62/Article XIII/Division 9 of the Code of the City of Miami, Florida, as
amended, entitled "Zoning and Planning/Zoning Approval for Temporary Uses and Occupancies;
Permit Required/Farmers' Market Pilot Program," is further amended in the following particulars:{1}

DIVISION 9. FARMERS' MARKET PILOT PROGRAM
Sec. 62-622. Farmers' Market Ri-iot Program.
(a) Intent. In order to encourage economic and community development, promote the health of
residents and provide access to nutritious substance, the following pilot program is instituted, for a
period of two (2) years and will automatically terminate on January 1, 2014, unless otherwise
extended by an affirmative vote of the City Commission.
Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance
is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective thirty (30) days after final reading and
adoption thereof. {2}

{2} This Ordinance shall become effective as specified as herein unless vetoed by the Mayor within
ten (10) days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall
become effective immediately upon override of the veto by the City Commission or upon the effective
date stated herein, whichever is later.
