HomeMy WebLinkAboutR-15-0157City of Miami Legislation Resolution: R-15-0157 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14-01075zt1 Final Action Date: 3/26/2015 A RESOLUTION OF THE MIAMI CITY COMMISSION, RESCINDING, DUE TO THE REASONS STATED HEREIN, THE VOTE PASSING ON FIRST READING AN AMENDMENT TO ORDINANCE NO. 13114 (MIAMI21 CODE) ON JANUARY 22, 2015, WHICH AMENDED ARTICLE 7, SECTION 7.2, ENTITLED "PROCEDURES AND NONCONFORMITIES", TO MODIFY PARKING REQUIREMENTS FOR ADAPTIVE USES. WHEREAS, the City Commission in considering an amendment to Ordinance No. 13114, the Miami21 Code, entitled "Procedures and Nonconformities" to modify Parking Requirements for adaptive reuses, had at a duly noticed public hearing, continued their consideration of this amendment to a date certain of March 26, 2015; and WHEREAS, through a scriveners' error, inadvertence, or excusable neglect, this same amendment was scheduled to be heard by, and was passed on first reading on January 22, 2015; and WHEREAS, Florida Statute 286.0114 provides that the public has a right to be heard on any proposition before a Board or Commission before official or final action is taken on an item; and WHEREAS, interested members of the public who were advised they could address the City Commission relative to this item on March 26, 2015 were inadvertently deprived of their due process right to be heard and their right to have access to their public officials when this ordinance amendment was passed on first reading as item PZ. 15 on January 22, 2015; and WHEREAS, due to the foregoing, a Motion to Rescind the City Commission vote taken on January 22, 2015 was made, considered and adopted by the City Commission on March 26, 2015; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals set forth in the preamble to this Resolution are incorporated by reference herein. Section 2. The passing on first reading of an amendment to Ordinance No. 13114 (Miami21 Code) on January 22, 2015, which amended Article 7, Section 7.2 ,entitled "Procedures and Nonconformities" , to modify parking requirements for adaptive uses which was mistakenly brought to the City Commission for first reading on January 22, 2015, is rescinded. Section 3. Consideration of this Ordinance Amendment will proceed as provided by applicable laws and regulations. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
