A RESOLUTION OF THE MIAMI CITY COMMISSION URGING GOVERNOR RICK
SCOTT AND THE MEMBERS OF THE FLORIDA LEGISLATURE TO ADOPT
LEGISLATION PREVENTING INDIVIDUALS DIVERTED FROM THE CRIMINAL
JUSTICE SYSTEM FROM ENTERING ASSISTED LIVING FACILITIES OR
COMMUNITY RESIDENTIAL HOMES LOCATED IN PREDOMINANTLY
LOW -DENSITY SINGLE-FAMILY AND DUPLEX NEIGHBORHOODS; DIRECTING
THE CITY CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE
OFFICIALS STATED HEREIN.
WHEREAS, Sections 419 and 429, Florida Statutes, allows for smaller Assisted Living Facilities
and Community Residential Homes in predominantly single-family and duplex residential
neighborhoods; and
WHEREAS, said facilities, when properly operated and caring for patients specified under
Sections419 and 429, Florida Statutes, do not tend to cause negative impacts to the surrounding
neighborhood; and
WHEREAS, some of these facilities have allowed individuals diverted from the criminal justice
system to reside therein, rendering these facilities de facto half -way homes; and
WHEREAS, said diverted individuals from the criminal justice system are suddenly placed in a low
density residential neighborhood, altering the character of the area and causing problems for the
surrounding residents; and
WHEREAS, the City of Miami requests that the Florida Legislature amend Sections 419 and 429,
Florida Statutes, to prevent such continued actions by some of these facilities;
NOW, THEREFORE, BE IT BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Resolution.
Section 2. The Miami City Commission urges Governor Rick Scott and the members of the Florida
Legislature to adopt legislation preventing individuals diverted from the criminal justice system from
entering Assisted Living Facilities and Community Residential Homes in predominantly single-family
and duplex neighborhoods.
Section 3. The City Clerk is directed to transmit a copy of this Resolution to Governor Rick Scott
and the members of the Florida Legislature
Section 4. This Resolution shall become effective immediately upon its adoption and signature of

Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
