HomeMy WebLinkAboutR-24-0436City of Miami Resolution R-24-0436 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 16857 Final Action Date: 10/24/2024 A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING AND AUTHORIZING THE CITY ADMINISTRATION TO MOVE FORWARD WITH ENFORCEMENT OF THE GRAFFITI AND OTHER VIOLATIONS LOCATED AT 320 SOUTHEAST 1 STREET, ALSO KNOWN AS 100 SOUTH BISCAYNE BOULEVARD, MIAMI, FLORIDA BY NOVEMBER 29, 2024 OR TAKE THE NECESSARY ACTION TO BRING THE PROPERTY INTO COMPLIANCE THEREAFTER SHOULD THE PROPERTY OWNER FAIL TO DO SO. SPONSOR(S): Commissioner Joe Carollo WHEREAS, the property structure located at 320 Southeast 1 Street, also known as 100 South Biscayne Boulevard, Miami, Florida ("Property") has been in a state of disrepair for many years; and WHEREAS, the Property is owned by Northwestern Capital Corporation ("Property Owner") who purchased the nineteen (19) story building in 1989; and WHEREAS, the current assessed market value of the Property by the Miami -Dade County Property Appraiser is $67,417,005.00; and WHEREAS, the Property sits right on Biscayne Boulevard in the heart of downtown Miami across the street from City of Miami's ("City") waterfront and waterfront parks; and WHEREAS, the Property Owner has allowed the Property to become vandalized, graffitied, blighted, and abused due to lack of any concern for the condition it has deteriorated into as well as the effect on the entire downtown Miami community; and WHEREAS, the Property has been in its current dilapidated state for more than a year and once again, as the City prepares for its holiday events, many of which have a national audience, this eyesore remains; and WHEREAS, the Property has an active demolition permit issued by the City under permit number BD23-026913-001 since June of 2024 for plans that were not submitted until November of 2023; and WHEREAS, the Property Owner is still attempting plans revisions as late as October 2024, stalling the projected demolition of the total Property structure; and WHEREAS, Code Compliance Case Number 00073257 was opened by the City in December of 2023 noting, "The property has several permits in progress however the building is not secured. There are several points of entry into the vacant and unsafe structure: one door is open, one garage entry point is not completely secured, and several boarded -up entry points have been broken through. The property has graffiti all throughout the first layer, however there City of Miami Page 1 of 2 File ID: 16857 (Revision:) Printed On: 11/20/2024 File ID: 16857 Enactment Number: R-24-0436 is graffiti all the way up to the top floors, which Miami Dade Property Appraiser lists at 19 floors."; and WHEREAS, in almost one (1) year, no progress has been made to secure the structure or clean up the graffiti that has become a glaring eyesore on downtown Miami; and WHEREAS, the City Administration is directed to begin taking action to clean up and/or clear out the Property should the Property Owner fail to do so by November 29, 2024; and WHEREAS, the City Administration is directed and authorized to take any necessary action and provided for by the City Code and Florida Statutes to do so; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Miami City Commission hereby directs and authorizes the City Administration through the necessary City Departments to take action to remove the blight and other violations present at the Property after November 29, 2024.
