HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 15-00202 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BYA FOUR -FIFTHS (4/5) AFFIRMATIVE VOTE, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGERS EMERGENCY FINDING, THAT IT IS MOST ADVANTAGEOUS FOR THE CITY OF MIAMI ("CITY") TO WAIVE THE COMPETITIVE SEALED BIDDING PROCEDURES, PURSUANT TO SECTION 18-90 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, RETROACTIVELY APPROVING THE SELECTION OF GREATER MIAMI CATERERS, INC., A STATE OF FLORIDAAPPROVED FOOD VENDOR, TO PROVIDE FOOD SERVICES FOR THE DAYCARE AND AFTERSCHOOL FOOD PROGRAMS FOR THE CITY PARKS AND RECREATION DEPARTMENT, FOR A PERIOD NOT TO EXCEED ONE HUNDRED EIGHTY (180) DAYS, ALLOWING FOR CONTINUITY OF SERVICE AND PROCUREMENT OF A NEW CONTRACT. WHEREAS, the City of Miami's ("City") Parks and Recreation Department ("Parks") is a participant in the State of Florida Child Care Food Program; and WHEREAS, the children in the Parks Day Care program are served breakfast, lunch, and a snack daily, and snacks are also provided for the Afterschool Program (collectively "Programs"); and WHEREAS, the current vendor under contract notified Parks on January 16, 2015 that they are no longer in business, and will not provide meals for the Programs; and WHEREAS, the City Manager, pursuant to Section 18-90 of the Code of the City of Miami, Florida, as amended ("City Code"), approved an emergency bid waiver to secure Greater Miami Caterers, Inc., a State of Florida approved vendor, for the provision of food service for the Programs, for a period not to exceed one hundred eighty (180) days, to allow for continuity of service and sufficient time for the City Procurement Department to competitively solicit these services for a long-term contract; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Commission finds, by a four -fifths (4/5) affirmative vote, ratifying, approving, and confirming the City Manager's emergency finding, that it is most advantageous for the City to waive the competitive sealed bidding procedures pursuant to Section 18-90 of the City Code, retroactively approving the selection of Greater Miami Caterers, Inc., a State of Florida approved food vendor, to provide food services for the Programs for Parks for a period not to exceed one hundred eighty (180) days, allowing for continuity of service and procurement of a new contract. Section 3.
