This is an opportunity to utilize a scenic parcel on Virginia Key. Through this RFLI, the City of Miami ("City") is seeking offers from qualified and experienced entrepreneurs interested in developing this site for a remunerative commercial use under a lease. Overview The City is seeking Letters of hlterest from qualified Respondents ("Respondents") willing to propose, develop and implement an exciting and economically remunerative use for a property located at 3801 Rickenbacker Causeway (on Arthur Lamb Jr. Road), in the vicinity of the old Jirnbo's parcel, Miami, FL 33149 ("Property") located in Virginia Key. It is the City's intention to solicit competitive bids for the use of this Property and enter into negotiations for a lease ("Lease") for the use of the Property for a five (5) year term. Property: Approximately 2,056 square feet of a recreational support facility. Legal Description: See Legal Description and Topographic Survey attached herewith as Attachment I and II. Zoning: CS Zone under Zoning Ordinance Miami 21 which allows for structured and unstructured recreational programs. RFLI Goals: To attract commercially and economically viable use(s) which are allowable under the Miami 21 Zoning Code and additionally promise: 1) to be economically remunerative; 2) generate fair market use fees for the City; 3) to contribute to the transformation of Virginia Key into a vibrant recreational area. Respondent's activities and operations should include but are not limited to: bicycle, canoe, kayak, paddle board with instruction, equipment rentals, and guided tours. Additional ancillary uses may include support services, sales of related merchandise, and snacks and refreshments. Prohibited and/or unauthorized uses include any motorized activity (i.e. boats, motor bikes, jet skis, jet packs, etc.) be it on land or water. 3 Existing Improvements: The City of Miami will provide a 2,056 square feet facility comprised of 2 pre -fabricated buildings joined by an elevated deck and an outdoor storage area. There is a designated space for a four (4) stalled bike wash area on the Property. The City will also provide the parking facility, (see Fig. 1). Respondent will be responsible for providing the storage containers for use in the outdoor storage area. Respondent will assume full responsibility to secure site in the event of flood or hurricane warning. A boat launch ramp is in close proximity of the facility. Property: No representations or warranties whatsoever are made as to its condition, state or characteristics. No representation whatsoever is made as to any environmental or soil matter. 4 Regulatory Process: Taxes, Impositions: Minimum Monthly Rent Requirement: Other Requirements: Grounds For Disqualification: Registration Fee: Each Respondent to this RFLI is responsible for determining which permits and approvals will be required for its use of the Property and any improvements it may propose. The Successful Respondent, at its sole cost and expense, shall be responsible for acquiring all required permits, licenses, and approvals from all agencies with jurisdiction, including, but not limited to, the City, Miami -Dade County, the State of Florida, federal agencies and all applicable public authorities or utilities. Additionally, all improvements must comply with all applicable building, fire, zoning, health and other code requirements. The Successful Respondent is responsible for all taxes and assessments due on the Property, including ad valorem taxes. The Successful Respondent will be required to pay for any survey(s), site plans and application fees required. The Successful Respondent shall be responsible for payment in lieu of taxes fees ("PILOT") during the term of the Lease in the event the Property becomes exempt from ad valorem real estate taxes. The Successful Respondent shall propose to the City, a Rent amount to lease the space. The City's minimum monthly Rent starts at $750.00. A security deposit equal to the current rent, insurance coverage, a payment and performance bond, will be required, amongst other requirements for the execution of the Lease. Failure to meet the minimum RFLI requirements will be grounds for disqualification. No RFLI responses will be accepted from individuals or entities who have or whose principals have past, present or pending litigation with the City or who have been disbarred or suspended from doing business with the City. Only those Respondents who register can participate. For registration as an on official Respondent and to receive a complete RFLI package and RFLI addenda, Respondent must submit a non-refundable fee of $150.00, in the form of a cashier's check, money order, or official bank check, made payable to the City of Miami, along with the completed Registration Form, attached as Exhibit "A". 5 Earnest Money Deposit: An earnest money deposit of $2,500.00, payable to the City of Miami, in the form of a cashier's check, money order, letter of credit, or official bank check, is required to accompany the proposal submissions. This earnest money deposit is due upon proposal submission and is fully refundable to those Respondents not selected. Proof of hnsurance: The Successful Respondent shall furnish Certificate(s) of Insurance to the City, which indicate that insurance coverage has been obtained which meets the requirements as outlined below in Exhibit "F". Optional Pre -submission Conference and Site Visit: The City will conduct a one -tune Pre -submission Conference on January 31, 2014. The Pre -submission Conference will take place at a location to be determined. Following the Pre -submission Conference, City staff will guide prospective Respondents on a one-time, site visit inspection of the Property. Attendance of the Pre -submission Conference and site visit is optional; however, prospective Respondents are strongly advised to attend. Respondent Entity: At the time of submission of the RFLI responses, the Respondent must be a business entity (sole proprietor, partnership, limited liability company or corporation, for example) and authorized to do business in the State of Florida, Miami -Dade County and the City under the bidding business entity's legal name. Any person(s) included in Exhibit "B" ("RFLI Submission Form") may not be substituted or withdrawn from, participation after the Submission Deadline date unless the City Manager specifically authorizes in writing a request for substitution. Lease Agreement: A Lease between the parties will be required upon selection of the Successful Respondent. (A sample copy of a Lease is available upon request.) II. Deadline for Receipt of Information / Clarification This RFLI is subject to the Cone of Silence Section 18-74 of the City of Miami Ordinance No. 12271. Pursuant to the Cone of Silence, any request for additional information or clarification must be received in writing no later than 2:00 p.m. on March 5, 2014. Interested individuals ("Respondents") may e-mail or fax their requests to the attention of Olga Zamora, Sr. Project Representative, City of Miami, Department of Public Facilities at the following E-mail: ozamora@miamigov.com or to fax 305.400.5089. 6 III. Cone of Silence Pursuant to Section 18-74 of the City of Miami Charter, a "Cone of Silence" is imposed upon each RFP, RFQ, RFLI, or IFB after advertisement and terminates at the time the City Manager issues a written recommendation to the Miami City Commission. The Cone of Silence prohibits any communication regarding RFPs, RFQs, RFLI or IFB (bids) between vendors, representatives, City staff, and others. The Cone of Silence shall apply to this RFLI. IV. Submission Requirements Respondents must complete and execute all the forms attached as Exhibits A through E inclusive, and must provide a narrative response to Question IV(e) below. For your convenience, a checklist entitled "Recreational Support Facility RFLI #12-13-068 Checklist" is attached on page 2 of this document to ensure you have completed all the requirements for this RFLI submission. a) RFLI Registration Form: Complete Registration Form attached hereto as Exhibit «A» b) RFLI Submission Form: Fill out completely the RFLI Submission Form attached herewith as Exhibit "B". Any missing information will be considered not responsible or non -responsive and will be grounds for disqualification from the RFLI process. c) Project Team Qualifications: Please complete the Project Team Experience sheets attached hereto as Exhibit "C" providing details on the qualifications and experience of your proposed Business Team and Development Team, as applicable. Provide the proven project experience of the Business Team and/or Development Team as it relates to project(s) previously implemented by your principals, which are the same or similar in nature to the proposed project. d) Certifications: Complete the appropriate Certification of Authority attached in Composite Exhibit "D". e) Disclosure/Disclaimer: Please complete the Respondent's Disclosure/Disclaimer attached hereto as Exhibit "E". f) Respondent's Organizational History/Structure and Chart: In a narrative form, please describe the Respondent's organizational and business history and explain why the Respondent's background makes it ideal for this opportunity. Please provide your organizational chart. g) Financial Capacity/Financial References: Respondents shall provide evidence of financial wherewithal or financing from a financial institution showing the Respondent's capacity to develop, implement, maintain, and operate the proposed commercial enterprise being proposed by the Respondent and undertake the proposed improvements on the Property. Please note that the Letter of Commitment must be on the financial institution's letterhead stationery. The City reserves the right, at the City's sole discretion, to request additional information from the Respondent for the purposes of clarifying any financial statement or documentation included in the RFLI Response. h) Insurance Requirement: Within ten (10) working days following notice of award by the City the Successful Respondent shall furnish to City Certificate(s) of Insurance which indicate that insurance coverage has been obtained which meets the requirements as outlined below in Exhibit "F". This RFLI number and/or title of this RFLI must appear on each certificate. All policies and/or certificate(s) of insurance are subject to the review and approval by the City's Risk Management Department prior to approval. Certificate(s) will indicate no modification or change in insurance shall be made without thirty (30) days written advance notice to the certificate holder. If insurance certificates are scheduled to expire during the contractual period, the Successful Respondent shall be responsible for submitting new or renewed insurance certificate(s) to the City at a minimum of ten (10) calendar days in advance of such expiration. In the event that expired certificates are not replaced with new or renewed certificates which cover the contractual period, the City may suspend the contract until such time as the new or renewed certificate(s) are received by the City in the manner prescribed in this RFLI. The City may, at its sole discretion, terminate the Lease for cause and seek re -procurement damages from the Successful Respondent in conjunction with the terms and conditions of this RFLI. The Successful Respondent shall be responsible for assuring that the insurance certificate(s) required in conjunction with this Section remain in force for the duration of the contractual period; including any and all option terms that may be granted to the Successful Respondent. i) Additional Information: Provide any other information, for any proposed improvements to the Property, as needed to describe the Respondent's proposed use or capability to implement the project. V. EVALUATION COMMITTEE The City Manager shall create an Evaluation Committee ("Committee") to evaluate each Proposal to determine which thin, corporation, joint venture, partnership, individual, or other legal entity presents the proposal that is most advantageous and in the City's best interest. The Committee may require an oral presentation from Respondent(s). Respondents shall be evaluated and awarded points on the basis of the following Evaluation Criteria: 8 Overall Experience and Qualifications (including availability of complete reference information) Proposed Minimum Monthly Rent Proposed Use and Improvements to Property 30 % 30 % 40 % The Committee will review and evaluate the Proposals. The Committee will be responsible for recommending to the City Manager the most qualified firm with whom to negotiate a Lease. The City Manager shall have the right to approve the Committee's recommendation or reject the Committee's recommendation and instruct the Committee to re-evaluate and make further recommendations, or reject all proposals. In the event that the City Manager accepts the Committee's recommendation, the City will then negotiate a Lease with the Successful Respondent to be submitted to the City Commission for approval. The Successful Respondent will be required to sign the Lease provided by the City, a sample of which is available upon request. The City reserves the right to accept any proposal deemed to be in the best interest of the City, to waive any irregularities in any proposal, and/or to reject any and/or all proposals at any time before or after receipt of the RFLI proposals or during the review and evaluation process, without undertaking the complete evaluation process and without re -advertising for new proposals. In the event that negotiations with the Successful Respondent fails, or should the Successful Respondent fail to enter into a Lease with the City, the City may then negotiate with the second highest ranking bidder without reissuance of the RFLI, and, if necessary, with the third highest ranking bidder in the event that the second highest ranking bidder is unwilling or unable to either negotiate with or enter into a Lease with the City. Any proposals which have been submitted by Respondent entities (or their principals) which have defaulted on City contracts or have been terminated from a City contract within the past five (5) years for poor or inadequate performance will be automatically disqualified from this RFLI selection process. VI. Indemnification of the City Respondent, shall indemnify, defend, save and hold harmless the City, its officials, employees and agents ("Indemnitees") from and against all loss, costs, penalties, fines, damages, claims, expenses, including attorney's fees or liabilities ("Liabilities") arising out of, resulting from or in connection with: (i) the performance or non-performance of the services, supplies, materials and equipment contemplated by this RFLI and Lease, which are directly or indirectly caused, by any act, omission, default, professional errors or omissions, or negligence of the Respondent, its employees, agents or subcontractors ("Respondent"), regardless of whether it is, or is alleged to be caused in whole or part (whether joint, concurrent or contributing) by any act, omission, default, breach or negligence of the Indemnitees, unless such injuries or damages are ultimately proven to be the result of grossly negligent or willful acts or omissions on the part of the Indemnitees; or (ii) the failures of the Respondent to comply with any of the paragraphs provisions herein; or (iii) the failure of the Respondent to conform to statutes, ordinances, or 9 other regulations or requirements of any governmental authority, federal, state, county, or city in connection with the performance of this RFLI and Lease, or any Amendment to same. Respondent expressly agrees to indemnify and hold harmless the Indemnitees, from and against all liabilities which may be asserted by an employee or former employee of Respondent, or any of its subcontractors, as provided above, for which the Respondent's liability to such employee or former employee would otherwise be limited to payments under state Worker's Compensation or similar laws. This section shall be interpreted in a manner to comply with any applicable Florida Statues, including, without limitation, 725.06 and 725.08, F.S. if applicable. This Indemnification shall survive the cancellation or expiration of the RFLI and the Lease. VII. Receipt of Responses Provide one (1) original and twenty-two (22) copies of the signed and dated proposal, accompanied by the required documentation to the Office of the City Clerk, Attn: Todd B. Hannon, 3500 Pan American Drive, First Floor, Miami, Florida 33133 no later than 2:00 p.m. March 19, 2014. Responses must be clearly marked and labeled on the outside of the envelope/package referencing the RFLI as follows: Recreational Support Facility/Virginia Key, Request for Letters of Interest (RFLI). At this time, the City has decided not to break ground on the recreational support facility until the Successful Respondent is selected and approved to operate the facility. This shall allow for the Successful Respondent to recommend minor design improvements or reasonable modifications to the recreational support facility, if any. Q. 2 Is there any opportunity to place a temporary structure anywhere on the water side or by the launching area to store paddleboards? A. 2 The water side and the launching areas are public areas. They are outside of the lease area being offered through this RFLI. If the Successful Respondent wishes to place a temporary structure anywhere in the water side or by the launching area to store paddleboards, then proper permitting must be obtained by the Successful Respondent. Q. 3 Please clarify if you have any plans for the Australian Pines or the Brazilian Pepper adjacent to the launching area? Will these be removed? What is the clean-up plan for the area adjacent to the launching area? A. 3 The water side and the launching areas are public areas. They are outside of the lease area being offered through this RFLI. At this time, there is no official clean-up plan for the area surrounding the recreational support facility; however, the City recognizes that its maintenance shall impact the services to be provided by the Successful Respondent. The City's Parks department shall be maintaining the areas adjacent to the Page 1 launching as well as the launching area itself. An official clean-up and improvement plan for the area will be established by the City's Parks department. The plan shall be disseminated to the public as part of this RFLI. Q. 4 Please clarify if the ramp in the launch area shaflremain as it is or if there are plans to change or repair it? A. 4 The water side and the launching areas are public areas. They are outside of the lease area being offered through this RFLI. At this time, there are no official plans to change or repair it. If the City's Capital Improvements department and/or Parks department establish plans for improvements to the ramp, then these plans shall be disseminated to the public as part of this RFLI. Q. 5 What restrictions are there on the ability to have signage in and around the area advertising and promoting the business? A. 5 After the Successful Respondent is approved by the City of Miami Commission to operate at the recreational support facility, the Successful Respondent, shall be permitted to place signs or posters, exclusively as related to its operations on the areas designated on the exterior and interior of the Property. There shall be no signs, advertising materials, or other objects, placed or hung on any portion of the Property changing or modifying the exterior or interior of the Property, except as provided for in the City of Miami Code. Approval from all governmental authorities having jurisdiction must be obtained, and must comply with all applicable requirements set forth in the City of Miami Code and Zoning Ordinance. Q. 6 Are there any restrictions on safety or rescue motorized vessels accessing the water in this area? A. 6 The waters near the Property require knowledge of the area as the entrance to the harbor is unmarked and bordered by shallow rock bottom. All of the City's Marine Patrol vessels are able to access the water area near the Property. The City's Fire department fireboat may not be able to enter access the area during lower tides, but the Fire department has at least one other smaller fire boat that can access the waters near the Property. Q. 7 If you see two submissions that might make a good collaboration, would you be amenable to putting those two parties together? If it's possible, then can you ask somewhere on the RFLI application, "Would you be open to collaborations?" A. 7 No, the City's goal through this RFLI is to identify one Successful Respondent who provides activities and operations such as, but not limited to, bicycle, canoe, kayak, paddle board with instruction, equipment rentals, and guided tours. Additional ancillary uses may include support services, sales of related merchandise, and snacks and refreshments. If qualified Respondents wish to, on their own, collaborate with other entities with different, complementing specialties, this is allowed. As stated in the RFLI package, "At the time of submission of the RFLI responses, the Respondent must be a business entity (sole proprietor, partnership, limited liability company or corporation, for example) and authorized to do business in the State of Florida, Miami -Dade County and the City under the bidding business entity's legal name. Any person(s) included in Exhibit 'B' ("RFLI Submission Form") may not be substituted or withdrawn from participation after the Submission Deadline date unless the City Manager specifically authorizes in writing a request for substitution." Q. 8 Will it be strictly a concession access facility or will the Successful Respondent be able to do something similar to what the National Parks Services does with its Commercial Use Applications (CUA)? A. 8 The Successful Respondent approved by the City of Miami City Commission to operate and lease the recreational support facility shall be the only authorized entity to operate at the facility. The Successful Respondent may have the option to enter into subleases, with prior written authorization from the City Page 2 Manager or his/her authorized designee, with commercial operators interested in providing approved commercial services at the facility. Q. 9 is the area patrolled at night? A. 9 Yes, The City's Police department has a beat officer assigned to the Rlckenbacker Causeway, Miami Marine Stadium and Virginia Key areas. Additionally, there is a Neighborhood Resources Officer (NRO) also assigned to these areas who, at a minimum, patrols the Property twice in a 24-hour period. The Police department also has Problem Solving Teams (PST) assigned to the areas. Please note, the City's Police department is also available to provide technical assistance to help businesses in these areas improve their safety practices aimed at securing property and preventing theft. A. 1 The City's Parks department has a report showing the number of cars entering the park on a monthly basis. The report shall be provided as Addendum 5. Q. 2 What are the current and long term plan with the bicycle trails? Is there a concessionaire in place for the bicycle trails? What access to the trails is permitted? A. 2 The City's Parks department has a good working relationship with the Bike Club, a volunteer group of cycling enthusiasts, and both entities work together to improve the trails. The mountain bike trails are self -sustained. In the future, the trail may be expanding, but it will take time and resources. There are some restoration projects of the nature areas also near the trail and all of that has an effect on the growth of the trail. In terms of access to the trails, they are open for public use; however they have different levels of difficulty and require a helmet to be worn. The City's Parks department is finalizing the details to a Request For Proposals (RFP) that will identify a bike/kayak/paddleboard concessionaire to operate rentals and tours. Q. 3 Are additional structures limited as per the plans provided? Will anything other than the two vendors provided containers be considered? A. 3 The City has provided plans of the recreational support facility it intends to build and subsequently lease to the Successful Respondent. At this time, the City has decided not to break ground on the recreational support facility until the Successful Respondent is selected and approved to operate the facility. This shall allow for the Successful Respondent to recommend minor design improvements or reasonable modifications to the recreational support facility, if any. Page 1 Q. 4 May additional mobile structures be brought onsite for day use? A. 4 Additional mobile structures that provide ancillary or complimentary services to the Successful Respondent's services may be brought within the lease area for the recreational support facility. Q. 5 Please confirm the park will supply and maintain the bathrooms, plumbing and electrical. A. 5 The maintenance of the plumbing and electrical within the lease area for the recreational support facility shall be the responsibility of the Successful Respondent. The maintenance of the bathrooms within the lease area for the recreational support facility shall be the responsibility of the Successful Respondent. Q. 6 Who is responsible for maintenance and repairs of the City provided structure, including restrooms? A. 6 Minor repairs and maintenance shall be the responsibility of the Successful Respondent. Q. 7 Will the containers have A/C installed? A. 7 The plans for the recreational support facility show pre -fabricated buildings/trailers (the restrooms and the vendor trailer), which will have air conditioning (A/C). The plans also show two areas labeled "Future Storage/Container Area". This area shall be for the Successful Respondent to place its own storage containers. Q. 8 The dock by Shrimpers Lagoon is in disrepair, portions are falling into the lagoon. This is outside the project area. Are repairs or replacement possible by either the City or the winning bidder? A. 8 Correct, the dock by the Shrimper's Lagoon is outside of the lease area being offered through this RFLI. There are no official plans currently in place to change or repair it; however, the City's Capital Improvements department intends to repair the seawall, the dock and the ramp. Once repair plans are finalized by the Capital Improvements department and/or Parks department implement plans for improvements to the dock, then these plans shall be disseminated to the public as part of this RFLI. As a note, the City's Parks department was awarded a Florida Inland Navigation District (FIND) grant and is in the process of identifying the necessary matching dollars required of the City in order to repair the seawall and subsequently allow for a dock, or floating dock, to be placed at the site. Any Respondent to this RFLI offering to repair and replace the dock outside of the lease area shall not receive any additional points or consideration. The Successful Respondent to this RFLI may, at its sole expense, undertake the repair or replacement of the dock so long as such work is properly permitted by state and local regulatory agencies. No rent credit or abatement shall be provided to the Successful Respondent for any repair or replacement work performed outside of the lease area. Q. 9 Boat Ramp — It too is in disrepair, steep, and slippery. The incline is greater than optimal for safe launching. Will this be addressed by City? Are repairs or replacement possible by either the City or the winning bidder? A. 9 The boat ramp is outside of the lease area being offered through this RFLI. (Note: Q. 4 in Addendum 3 is similar in nature to this question. This answer shall replace and supersede A. 4 in Addendum 3) There are no official plans currently in place to change or repair it; however, the City's Capital Improvements department intends to repair the seawall, the dock and the ramp. Then, it gradually slopes up to zero. Q. 11 Are grills permitted onsite? If so, what type and what limitations exist for concession use? A. 11 Grills are not permitted inside the recreational support facility lease area or outside of the lease area by patrons as it poses a safety issue. The City's Parks department has tentative, long-term plans, to populate some of the green space outside of the lease area with picnic tables and the allowed per Code grills (using charcoal only) for enhanced use of the open space. Are odor levels recorded and are reports available for review? A. 14 The Miami -Dade County Water and Sewer Department (WASD) is the agency best qualified to address this question. Mr. Robert Fergen, Division Chief, Wastewater Treatment & Maintenance at WASD, is Miami -Dade County's Waste Water Treatment Plant contact person. A. 15 The City prefers that professional or government sponsored trappings services be used to ensure the humane treatment of wildlife in the area. Page 3 Q. 16 What are the current ad valorem taxes for the subject site? A. 16 The recreational support facility shall be located at 3801 Rickenbacker Causeway, which is part of Folio 01- 4216-000-0011of the Miami -Dade County property records. It is currently exempt from ad valorem taxes. The Applied Exemption was $3,284,800. Q. 17 Will the winning bidder be able to appeal tax valuations? A. 17 In the event the lease area is subject to taxation, the Successful Respondent may appeal the tax by immediately notifying the City of its intention to appeal said tax and shall furnish and keep in effect a surety bond of a responsible and substantial surety company reasonably acceptable to the City in an amount sufficient to pay one hundred percent of the contested tax, with all interest on it and costs and expenses, including reasonable attorneys' fees, to be incurred in connection with it. Q. 18 Please provide a sample copy of the proposed lease. A. 18 A draft sample shall be provided on the RFLI's website as Addendum 6. Q. 19 In the event of flood or adverse weather, exactly what will the concessionaire be required to remove, in terms of containers/trailers? A. 19 The Successful Respondent shall be responsible for monitoring flooding or adverse weather conditions through the local news media as well as any reports issued by the Emergency Management System. The Successful Respondent shall be responsible for following preparedness guidelines and taking prudent measures to minimize damage to the recreational support facility, to any person, or to life. Q. 20 What flood conditions will determine whether containers are to be removed? A. 20 The Successful Respondent shall be responsible for monitoring flooding or adverse weather conditions through the local news media as well as any reports issued by the Emergency Management System. The Successful Respondent shall be responsible for following preparedness guidelines and taking prudent measures to minimize damage to the recreational support facility to any person, or to life. As such, if a flood advisory is issued for the Miami -Dade County area, then the Successful Respondent shall need to immediately remove the containers. Q. 21 At what stage of a hurricane will containers need to be removed? A. 21 The National Weather Center issues information and warnings for South Florida throughout the hurricane season. The Successful Respondent shall be responsible for monitoring conditions through the local news media. The Successful Respondent shall be responsible for following preparedness guidelines and taking prudent measures to minimize damage to the recreational support facility, to any person, or to life. As such, containers will need to be removed as soon as a Tropical Storm warning is issued for the Miami area. Q. 22 Will containers require removal with each hurricane, or only under specific conditions? A. 22 Yes. Page 4 Q. 23 Will the areas outside the subject site be made available for rental by the city? If so, what areas, under what general circumstances, and who will coordinate the rentals? A. 23 As per City Code, the City's Parks department is in charge of overseeing the rental of space at the park. Any special events at the park shall need to be properly permitted through the Park department and/or Special Events department. Q. 24 Is a list of interested parties available (those at the pre -bid meeting and registered participants)? A. 24 A copy of the sign -in sheet from the Optional Pre -proposal Conference and Site Visit held on Friday, January 31, 2014 is available on the RFLI's website as Addendum 2. As of today, there are no registered participants. Q. 25 Are mobile food carts allowed? A. 25 The Successful Respondent approved by the City of Miami City Commission to operate and lease the recreational support facility shall be the only authorized entity to operate at the facility. The Successful Respondent may have the option to enter into subleases, with prior written authorization from the City Manager or his/her authorized designee, with commercial operators interested in providing approved commercial services at the facility. The areas outside of the lease area are not part of this RFLI. Please refer to City Code Chapter 38, Article II, Section 38-65 titled, "Peddling, vending and merchandising," for more information on regulations governing park areas. A. 26 No, the City wants to ensure that patrons visiting the recreational support facility, as well as other parks visitors, are safe; therefore, the City is not allowing the sale of beer and/or wine at the recreational support facility. Furthermore, possession or consumption of alcoholic beverages within park limits is prohibited, with a few exceptions as outlined in the City Code Chapter 38, Article II, Section 38-69 titled, "Alcoholic beverages; intoxicated persons," and Chapter 38, Article II, Section 38-70 titled, "Sale or dispensing of beer and/or wine for special events or programs in city parks".
