HomeMy WebLinkAboutLegislation (v2)City of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14-01188sc Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), CLOSING, VACATING, ABANDONING, AND DISCONTINUING FOR PUBLIC USE A PORTION OF NORTHEAST 31ST STREET, LYING EAST OF NORTHEAST 7TH AVENUE AND WEST OF BISCAYNE BAY; AND A PORTION OF NORTHEAST 31ST STREET, LYING 280 FEET WEST OF NORTHEAST 7TH AVENUE, AND 490 FEET WEST OF NORTHEAST 7TH AVENUE, MIAMI, FLORIDA. WHEREAS, the Plat and Street Committee ("Committee"), at its meeting on October 2, 2014, has reviewed the subject tentative plat entitled "ILANA," and determined that all technical requirements have been. met, and by a vote of six to zero (6 - 0) recommended approval subject to conditions of the vacation and closure as set forth; and WHEREAS, the City of Miami ("City") Department of Public Works and the Committee have studied the subject vacation and closure, and determined that it will not affect pedestrian or vehicular traffic circulation or access for public service; and WHEREAS, the Miami Planning, Zoning and Appeals Board ("PZAB"), at its meeting on December 17, 2014, following an advertised public hearing, adopted Resolution No. PZAB-R-14-077 by a vote of eight to zero (8-0), item PZAB.7, recommending APPROVAL, with conditions as stated in the staff analysis and with the covenant proferred by the applicant, of the vacation and closure as set forth; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City and its inhabitants, to grant the vacation and closure of a portion of the public right-of-way as hereinafter described, and deems it advisable to do so; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. Approximately a portion of Northeast 31 st Street, lying East of Northeast 7th Avenue and West of Biscayne Bay; and a portion of Northeast 31 st Street, lying 280 feet West of Northeast 7th Avenue and 490 feet West of Northeast 7th Avenue, Miami, Florida, more particularly described in Exhibit "A," is closed, vacated, abandoned, and discontinued for public use. Section 3. The City Commission accepts the covenant proferred by the applicant included in the record. The applicant shall record the covenant and furnish a certified copy of the recorded covenant to both the Director of the City's Planning and Zoning Department and Parks and Recreation Department. Approval of the requested vacation and closure shall be valid for a period of four (4) years, and shall remain independent of the referenced tentative plat during this period. Section 5. The approved final plat must be recorded within the four (4) year approval period of the requested vacation and closure. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1} APPRd VED AS TO FORM AND CORRECTNESS: VICE' ORIA ' ENDEZ CITY ATTORNEY Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
