PROJECT ADDRESS: A portion of Northeast 31st Street right-of-way, Tying between Biscayne Bay and Northeast 7th Avenue and approximately 280 feet west of Northeast 7th Avenue, and 490 feet west of Northeast 7th Avenue and its southerly prolongation lying westerly of Biscayne Bay. The Applicant proffers a new public park located on the bay front that provides greater public access and enjoyment of Biscayne Bay. The creation of new roadways upon recording of the plat, including Northeast 6th Ave between Northeast 31st Street and Northeast 32nd Street and Northeast 7th Avenue between 30th Terrace and Northeast 31st Street, will result in improved circulation throughout the neighborhood and greater public access to the bay front. 2. The general public, emergency, and service vehicles are currently using the entire length of Northeast 31st Street from Biscayne Boulevard to Biscayne Bay. 3. The proposed new roadways will improve access and circulation for the general public, emergency and service vehicles. The proposed Plat site will improve interconnectivity to the surrounding neighborhood and provide convenient access to the proposed park. 4. The proposed new roadways will improve vehicular and pedestrian traffic circulation throughout the entire neighborhood. The Plat and Street Committee members voted to recommend six (6) in favor and zero (0) in denial of this street closure request. 6. The street closure will promote and facilitate cohesive development, economic growth and revitalization of the lots that it abuts. Based on the above findings, the Planning and Zoning Department and the Plat and Street Committee recommends Approval of the request with the following conditions below: a. The property owner shall execute an agreement to run with the land to maintain the proposed park Tract F. b. A platted development restriction to comply with the requirements of the Miami Zoning Code concerning the Northeast 31st Street view corridor. c. No fence shall be permitted around proposed Tract E. d. If Tract E, adjacent to the public park, is developed for restaurant use, the sale of liquor shall be restricted. Antonio E. WHEREAS, the Plat and Street Committee ("Committee"), at its meeting on October 2, 2014, has reviewed the subject tentative plat entitled "ILANA," and determined that all technical requirements have been. met, and by a vote of six to zero (6 - 0) recommended approval subject to conditions of the vacation and closure as set forth; and WHEREAS, the City of Miami ("City") Department of Public Works and the Committee have studied the subject vacation and closure, and determined that it will not affect pedestrian or vehicular traffic circulation or access for public service; and WHEREAS, the Miami Planning, Zoning and Appeals Board ("PZAB"), at its meeting on December 17, 2014, following an advertised public hearing, adopted Resolution No. PZAB-R-14-077 by a vote of eight to zero (8-0), item PZAB.7, recommending APPROVAL, with conditions as stated in the staff analysis and with the covenant proferred by the applicant, of the vacation and closure as set forth; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City and its inhabitants, to grant the vacation and closure of a portion of the public right-of-way as hereinafter described, and deems it advisable to do so; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. Approximately a portion of Northeast 31 st Street, lying East of Northeast 7th Avenue and West of Biscayne Bay; and a portion of Northeast 31 st Street, lying 280 feet West of Northeast 7th Avenue and 490 feet West of Northeast 7th Avenue, Miami, Florida, more particularly described in Exhibit "A," is closed, vacated, abandoned, and discontinued for public use. Section 3. The City Commission accepts the covenant proferred by the applicant included in the record. The applicant shall record the covenant and furnish a certified copy of the recorded covenant to both the Director of the City's Planning and Zoning Department and Parks and Recreation Department. Approval of the requested vacation and closure shall be valid for a period of four (4) years, and shall remain independent of the referenced tentative plat during this period. Section 5. The approved final plat must be recorded within the four (4) year approval period of the requested vacation and closure. Section 6.
