A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING AN INCREASE TO THE PROFESSIONAL SERVICES AGREEMENT
("PSA") WITH TY LIN INTERNATIONAL/HJ ROSS, ("TY LIN/HJ ROSS"), FOR THE
PROVISION OF MISCELLANEOUS ENVIRONMENTAL ENGINEERING SERVICES,
IN AN AMOUNT NOT TO EXCEED $500,000.00, THEREBY INCREASING THE
TOTAL CONTRACT AMOUNT FROM $500,000.00, TO AN AMOUNT NOT TO
EXCEED $1,000,000.00; ALLOCATING FUNDS FOR SAID INCREASE FROM THE
APPROPRIATE CAPITAL IMPROVEMENT PROJECTS; FURTHER AUTHORIZING
THE CITY MANAGER TO EXECUTE AMENDMENT NO. 1 TO THE PSA WITH TY
LIN/HJ ROSS, IN SUBSTANTIALLY THE ATTACHED FORM, FOR SAID PURPOSE.
WHEREAS, on September 5, 2012, pursuant to Request for Qualifications No. 10-11-045, the
City of Miami ("City") executed a Professional Services Agreement ("PSA") with Ty Lin
International/HJ Ross, ("Ty Lin/HJ Ross"), for the provision of Miscellaneous Environmental
Engineering Services, in an amount not to exceed $500,000.00; and
WHEREAS, the City has experienced an increase in the demand for environmental
remediation services upon the recent and continued discovery of contaminated materials on public
park lands which were former landfill sites; and
WHEREAS, the City is expected to meet compliance with regulatory requirements set by the
Miami -Dade County Department of Regulatory and Economic Resources within a specified
timeframe; and
WHEREAS, Ty Lin/HJ Ross is experienced in the delivery of comprehensive environmental
remediation services and have performed site assessment and remediation cleanup action plans of
public lands throughout Miami -Dade County, including public park lands involving similar complex
environmental issues; and
WHEREAS, the site assessment strategies and the cleanup action plans that Ty Lin/HJ Ross
have and are in the process of proposing, have resulted in cost savings in an increasingly expensive
endeavor to achieve environmental compliance; and
WHEREAS, it is now necessary to enter into Amendment No. 1 with Ty Lin/HJ Ross,
increasing the PSA by $500,000.00, from $500,000.00 to an amount not to exceed $1,000,000.00;
and
WHEREAS, funds are to be allocated from the appropriate Capital Improvement Projects;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as fully set forth in this Section.
Section 2. An increase to the PSA with Ty Lin/HJ Ross, for the provision of Miscellaneous
Environmental Engineering Services in the amount of $500,000.00, thereby increasing the PSA
amount from $500,000.00, to an amount not to exceed $1,000,000.00, is authorized, with funds for
said increase, allocated from the appropriate Capital Improvement Projects.
Section 3. The City Manager is authorized {1 } to execute Amendment No.1 to the PSA, in
substantially the attached form, with Ty Lin/HJ Ross, for said purpose.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of the
Mayor. {2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10)
calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by the City Commission.
