Law Department Matter ID No. Purpose of Item: An Ordinance of the Miami City Commission amending Chapter 18, Article III, the City of Miami Procurement Ordinance, more particularly by amending Section 18-89, entitled "Contracts for public works or improvements", to modify local workforce participation requirements for competitively procured construction contracts as provided herein; containing a severability clause and providing for an effective date. Background Information: During the Commission Meeting of May 22, 2014, the Commission expressed concern with the apparently insufficient local workforce participation required for City projects for public works or improvements. In response to such concerns and pursuant to the Commission's directive, an ordinance revising the local workforce participation requirements of City Code Section 18-89, Contracts for public works or improvements, has been drafted and submitted for the Commission's review and approval. In an effort to improve the local workforce participation, the Capital Improvement Projects (CIP) Department has recommended a scaled approach reflecting an increasing number of local workforce laborers that would be required in proportion with the costs of such City projects for public works or improvements. For construction contracts with a value of $500k to $750k, one full time laborer from within the City of Miami throughout the duration of the project (new hire) For construction contracts with a value of $750k to $1 mil, two full time laborers """ This escalation can continue upwards at the same rate Verification of the labor force must be completed within 3 months (not 6 months0) after project has reached final completion (use this terminology) with the same penalty clause of 5% of the project retainage if the goal is not met.
