An Ordinance of the Miami City Commission amending Chapter 18, Article III, the City of Miami
Procurement Ordinance, more particularly by amending Section 18-89, entitled "Contracts for public
works or improvements", to modify local workforce participation requirements for competitively
procured construction contracts as provided herein.

Subject: Ordinance amending Section 18-89, Contracts for public works or improvements, for revisions
to the local workforce participation requirements.
Background Information:
At the May 22, 2014 Commission meeting, concerns were raised during the presentation of the African
Square Park Improvements and Renovations/Splash Park Project regarding the local workforce
participation requirements for public works and construction projects. The concerns addressed included
raising the local workforce participation percentage requirement under City Code Section 18-89 and
requiring that fifty percent_(S0% o) o_fsuch _local workforce_ percentage be from withinthe_district where
the project resides. After extensive market research of similar -sized government agencies and their local
workforce participation requirements, a draft ordinance revising said section of the Code has been
prepared to reflect a percentage scale ranging from 10% to 20% local workforce participation based on
the construction cost of the project. In addition, language was added to address the aspirational
requirement that the contractor shall strive to employ a minimum of fifty percent (50%) of the minimum
local workforce participation percentage requirements from within the district where the project resides.
Under the revised section of the Code, the contractor shall be required to submit to the City within
fifteen (15) days of notice to award, a Workforce Plan (Plan) outlining how the percentage will be met,
including the total number of persons that will be used by the contractor, broken down by trade and
labor category, minimum qualifications for each category, and the number of persons to be utilized in
each category. The Plan shall identify by name, address and trade category all persons proposed to
perform work under the contract currently on the contractor's payroll or positions to be hired by the
contractor, who reside within the city limits.
