STREET CLOSURE
REQUEST: Pursuant to Section 55-15 (c) of the Miami City Code, the applicant proposes the
closing, vacating, abandoning and discontinuing for public use a street.
PROJECT ADDRESS: A portion of Southwest 7th Terrace lying west of Southwest 8th Avenue

FINDINGS AND COMMENTS:
1. Southwest 7th Terrace from Southwest 8th Avenue to approximately 188 feet west of
Southwest 8th Avenue is an existing "dead end" roadway with no turn -around area at its
end. Random parking occurs on the public right-of-way and vehicles exiting the roadway
conflict with traffic on the adjacent avenue. The closure and vacation of this street will
reduce traffic conflicts at its intersection with Southwest 8th Avenue, a federal highway
under FDOT jurisdiction, and reduce conflicts with turning
2. The street is being used solely for the access benefit of the abutting property. The
general public, police, fire and service vehicles do not utilize the street to serve
properties outside the limits of the tentative plat.
3. The closure and vacation of the street allows the property to be joined creating two tracts
that provide full access for police, fire and service vehicles on two (2) sides of each tract.
There is no adverse effect on the ability to provide such service to the proposed tract of
land and the surrounding neighborhood.
4. The street right—of-way will be fully dedicated surrounding the proposed tracts allowing
for continuous pedestrian sidewalks. Traffic conflicts at its intersection with Southwest
8th Avenue are reduced, thereby improving motorist safety and improving traffic flow.
The dedication of the right-of-way, including corner radiuses, will allow the property to be
developed to enhance pedestrian traffic circulation.

5. The Plat and Street Committee members voted to recommend seven (7) in favor and
zero (0) in denial of this street closure request.
6. The street closure is consistent with the goals, objectives and policies of the Miami
Comprehensive Neighborhood Plan (MCNP). The street closure will promote and
facilitate cohesive development, economic growth and revitalization of the Tots that it
abuts.

PLANNING AND ZONING DEPARTMENT: Recommended approval.
PLAT & STREET COMMITTEE: Recommended approval on September 19, 2014, by

PURPOSE: This will close the portion of SW 7th Terrace that lies west of SW 8th
Avenue.
WHEREAS, the Plat and Street Committee, at its meeting on September 19, 2014, has reviewed
the subject tentative plat entitled, "Horners Addition to the City of Miami, Fla." and determined
that all technical requirements have been met and by a vote of seven to zero (7-0) recommending
approval of the vacation and closure as set forth; and
WHEREAS, the Department of Public Works and the Plat and Street Committee have studied the
subject vacation and closure and determined that it will not affect pedestrian or vehicular traffic
circulation or access for public service; and
WHEREAS, the Miami Planning, Zoning and Appeals Board, at its meeting on November 5, 2014
following an advertised public hearing, adopted Resolution No. PZAB-R-* by a vote of * to * (*-*), item
no. PZAB.4, recommending * of the vacation and closure as set forth; and
WHEREAS, the City Commission, finds that it is in the best interest of the general welfare of the
City of Miami and its inhabitants to grant the vacation and closure of a portion of the public right-of-way
as hereinafter described, and deems it advisable to do so;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The street approximately located at the portion of Southwest 7th Terrace that lies west
of Southwest 8th Avenue, Miami, Florida, more particularly described in Exhibit "A," is closed, vacated,
abandoned and discontinued for public use.
Section 3.Approval of the requested vacation and closure shall be valid for a period of four
years and shall remain independent of the referenced tentative plat during this period.
Section 4.The approved final plat must be recorded within the four year approval period of
the requested vacation and closure
Section 5.This Resolution shall become effective immediately upon its adoption and

Dear Mr. Garcia:
This firm represents 3BROAMIGO DEVELOPMENT LLC and 3BROAMIGO
DEVELOPMENT ONE LLC (collectively referred to as "Owner") the Owner of certain lands in
the City of Miami requesting the official vacation and closure of right of way for that portion of
S.W. 7th Terrace west of S.W. 8th Avenue.
The Owner is the owner of approximately 1.1 acres of land located between S.W. 8th
Street and S.W. 7th Street west of S.W. 8th Avenue, in Little Havana. This application seeks the
vacation and closure of a 30 foot wide, 189 feet long street that runs east west, bisecting a
portion of this city block.
This city "street" was created in 1909 when this area of the City of Miami was the
southwestern fringe of the City. The street was created by a subdivision of land recorded on
March 14, 1909 as "Horners Addition to The City of Miami, Fla.", 13 years after the
incorporation of the City of Miami (recorded at Plat Book B, Page 160 of the Public Records of
Miami Dade County). At that time, "Miami Avenue" was "Avenue D" and "Flagler Street" was
"Twelfth Street." 1 This remote part of the City was subdivided to create 32 small lots. Lots 1
through 8 were located on the first block, north of 20th Street, what is now S.W. 8th Street. And
the next four lots, 9, through 12, were separated by a 30 foot wide thoroughfare, that was not
given a name and was not dedicated for public use.

The designation of this thoroughfare as "Terrace" was first added in 1925, when the remnant
portions of land were subdivided by R.M. Simpson and "S.W. 7th Street" and "S.W. 7th Terrace"
were created by "Simpson Addition" (Plat Book 16, Page 37).

The apparent intent of this thoroughfare was to provide access to the eight (8) 50 x 75 ft. lots
abutting it.

105 years later, this small corner of the City of Miami is far from what Horner
envisioned. The S.W. 8th Street and S.W. 7th Street corridors are major east/west transit corridors
of the City and the small 3,750 square foot lots created by their new subdivision do not meet the
minimum lot standards of our Miami 21 Code, which require a minimum lot size of 5,000 square
feet for T6-80, the underlying zoning for the abutting properties owned by Owner.
More importantly, S.W.7th Terrace did not evolve into a major or minor city street in the
section of the City. S.W. 7th Terrace resumes as a street west of S.W. 97th Avenue. Closing and
vacating this portion of street will create a subdivision that complies with Miami 21 and that will
also eliminate a thoroughfare that does not provide vehicular or pedestrian access.
(1) Is it in the public interest, or would the general public benefit from the
vacation of the rights -of -way or easements?
The public will benefit from the closure of this road segment that is nothing more than a dead-
end 30 foot wide strip of land that does not benefit the public or the lands it abuts. The general
public does not use this street for pedestrian or vehicular access. In addition, closing the street
will permit the development of the parent tract with a retail development project, consistent with
the vision of Miami 21 in an important gateway area of the City.
(2) Is the general public no longer using the rights -of -way or easement, including
public service vehicles such as trash and garbage trucks, police, fire or other
emergency vehicles?
The general public does not use this segment of street for access or for public service vehicles, or
emergency access.
(3) Would there be no adverse effect on the ability to provide police, fire or
emergency services?
Neither fire, police nor emergency services currently use this limited dead end street for any
purpose. Closing this street will have no adverse effect on the ability to provide services. On
the contrary, the closing of the street will permit the development of the parent site, which will
have to be designed to improve police, fire and emergency services, as well as vehicular and
pedestrian circulation and traffic.
(4) Would the vacation and closure of the rights -of -way or easements have a
beneficial effect on pedestrian and vehicular circulation in the area?
As stated for criteria (1), above, the general public does not use this street for pedestrian access
or vehicular access. The street does provide vehicular access to the existing offstreet parking
spaces that serve the existing buildings and businesses. The redevelopment of the Owner's

property will include the demolition of these buildings, and replace them with a new retail
development that will have direct ingress/egress from S.W. 8th Avenue.
On September 19, 2014, the City's Plat and Street Committee considered this request for
vacation and closure of the streets and voted 7-0 in favor of the vacation and closure request.

TENTATIVE PLAT #1839 — A (FIRST RESUBMITTAL)
LOCATED ALONG THE WEST SIDE OF SW 8 AVENUE, BETWEEN SW 8 STREET AND SW 7 STREET.
Ladies and Gentlemen:
The City of Miami Plat and Street Committee, at its meeting of September 18, 2014, approved the above
tentative plat subject to the following revisions being made to the tentative plat, additional information being
provided and/or variances being granted. Please be advised that the processing of your tentative plat cannot
proceed until these conditions have been satisfied:
1. Location Sketch
a) Correct Subdivision names of the underlying plat and surrounding subdivisions.
b) Provide a fractional sectional description, including the city, county, and state.
2. On the application, clarify the street boundaries.
3. All property abutting the right-of-way to be closed and vacated must join in and execute the plat,
including the property at the west end of SW 7 Terrace.
4. Correction needed on proposed plat name.
5. Correct the Subdivision names of the surrounding subdivisions.
6. Add curve data abbreviations to legend.
7. Provide ties to street intersections with bearing and distance for the monument lines and the center lines
shown on the plat.
8. Show the existing easements on the main sketch.
9. Elevations must be referred to City of Miami Datum.
10. An approval letter from F.D.O.T. will be required prior to final plat submittal.
11. Modify the plat names to: HORNERS ADDITION TO CITY OF MIAMI FLA and SIMPSON
ADDITION, wherever they appear on the T-plat.
12. Provide a bearing and distance for the center line on S.W. 7 Terrace.
13. Show the areas to be dedicated as public right of way by the proposed plat, by using a solid line for the
existing Right of Way lines and a dashed line for the zoned Right of Way lines. Existing Right of way
lines for SW 7 Terrace to be depicted in solid lines.
14. Correct typo on SW 7 Terrace ("VACANTED").
15. Provide a tie to the nearest section corner, and provide a Certified. Corner Record.
16. Location and width of proposed and existing easements identified in the title opinion, will be shown on
the plat or in the notes or legend. If easements are not coincident with property lines, they must be
labeled with bearing and distances and tied to the principal lot, tract, or right-of-way.
17. Verify if the existing easements will be platted or will be accomplished by separate instruments. Access
to the antenna site must be provided and must accommodate City service and emergency vehicles.

18. Clarify the development intent for each tract.
19. Show the existing underground stormwater drainage system in the right of way including inverts, pipe
size, material type and direction.
20, Provide an Opinion of Title/proof of ownership for the narrow remnant parcel between existing lots 10
and lion the north side of SW 7 Terrace.
21. Consent from the easement holder is required for closure of SW 7 Terrace. SW 7 Terrace currently
serves as access to the antenna site.
22. Identify existing trees on the tentative plat and provide a tree list including common and botanical
names, height, diameter and spread.
23. Add a note that all buildings and structures are to be removed except the antenna and appurtenances.
24. Delete the arrow and label on SW 7 Street concerning a property corner.
25. A letter from Comcast is required to determine if any adjustments to their facilities or easements are
required.
26. Verify with Miami -Dade County that the proposed plat name is acceptable.
27. Ail encroachments across proposed tract and/or lot lines must be removed prior to final plat submittal.
28. An Opinion of Title, in the City of Miami Opinion of Title form., must be provided at the time of final
plat submittal.
29. Current backup documentation will be required for all who execute the final plat. A resolution for
authority to execute documents and a Certificate of Good standing from the Secretary of State are
required, if applicable.
30. Tentative plat application must be made with Miami -Dade County after receiving approval from the
City of Miami Plat and Street Committee.
31. Be advised that an incomplete final plat package will not be accepted by the City of Miami. It is the
owner's responsibility to work with his surveyor and his attorney to assure that everything is in order
before submitting the final plat package.
32. Be advised that if all requirements for scheduling the final plat for City Commission action are not in
order, the final plat will not be scheduled for a City Commission meeting.
33. A letter of concurrency from Miami -Dade County School Board is required prior to the final plat
approval (see contact sheet). The tentative plat name and tentative plat number must be included on the
application form.
34. A letter from the Miami -Dade Water and Sewer Department is required to determine if any adjustments
to their facilities or easements are required.
35. Add a revision date to page 2.
36. Add all symbols to the legend.
37. Correct spelling errors and the description of the base building line.
38. Existing utilities in the street to be closed and vacated must be relocated or easements must be created.
39. An opinion of title as to the reversionary rights for the right-of-way to closed and vacated will be
required by the Planning, Zoning and Appeals Board. The opinion of title must also address whether or
not there are individuals, in addition to the abutting property owners, having an interest in the right-of-
way to be closed and vacated. A copy of the opinion of title must be provided to the Public Works
Department.
40. The planning, Zoning and Appeals Board will require a sketch and legal description with a square
footage, on an 8 '/2 x 11" paper, for the proposed closure. Contact the Office of the Hearing Boards, at
305-416-2030. Provide a copy to the Public Works Department.
41. The Plat and Street Committee has reviewed the tentative plat of 3 Broamigo subdivision and
determined that all technical requirements contained in the Miami City Code Subdivision Regulations
have met and has approved the tentative plat. The members of the Plat and Street Committee have
further considered the request for vacation and closure of the street with respect to Miami City Code
requirements and have voted to recommend 7 in. favor and 0 in denial of this vacation and closure
request.
In addition to the above requirements, you should be aware of the following:

1. State and Iocal laws require the installation of various physical improvements in the public rights -
of -way when property is platted. These subdivision improvements include paving, drainage,
landscaping, sidewalks, etc. In some cases this could represent a substantial investment on your
part.
REQUIRED: The submission of an electronic copy of the tentative plat, in an AutoCAD version, to
the City of Miami Public Works Department, Roadway Plans Section will EXPEDITE the
preparation and enhance the ACCURACY of the subdivision improvement letter required for the
final plat approval.
2. The alteration, relocation or installation of utilities such as storm and sanitary sewers, electric,
telephone, -water, etc., caused by this plat will be at the property owner's expense. Also, utility
easements may be required on the property being platted.
3. A building permit will not be issued on the property being platted until the fmal plat is recorded or
as authorized by the City of Miami Code Section 55-10(i). Also, the Certificate of
Occupancy for any building'construction will be issued only after all the required subdivision
improvements have been completed.
4. Approval for fire flow requirements must be obtained from the Fire -Rescue Department prior to the
issuance of a building permit.
5. In order to mitigate problems associated with access and construction activities throughout the
neighborhood, the contractor/developer is encouraged to notify the affected neighborhood residents,
in writing, of the project starting and completion dates at the time of issuance of permits. The
contractor/developer may coordinate the notification of residents with the local City of Miami NET
Service Center.
6. Additional items must be provided to the City of Miami Department of Public Works before the
final plat is submitted to the City Commission for approval. You will be notified in writing as to
what these items are after the amount of the bond has been determined for the necessary subdivision
improvements.
7. Tentative plat approval is only valid for one (1) year and six (6) months from the date of the Plat
and Street Committee meeting at which time it was approved.
If you have any questions concerning these requirements, please refer to the attached sheet for the appropriate
person to contact.
