Purpose of Item: Law Department Matter ID No. An Ordinance amending City Code Chapter 54/Article 1 entitled "Streets and Sidewalks/In General" to close and vacate certain unused public alleys within the City. Background Information: There are numerous public alleys within the City that have not been paved and are not utilized for vehicular or pedestrian access including public service and emergency vehicles. These alleys may present a security and illegal dumping problem for abutting property owners and are difficult to properly maintain by city forces. Adoption of this Ordinance will revert the ownership, maintenance and liability of these certain alleys to the abutting property owners, thereby enabling owners to secure their property and maintain the alley as part of their yards. The reversion of ownership will also increase the size of the abutting property and possibly the appraised value of the land. An easement will be automatically reserved in the alleys vacated by this section for installation, maintenance and operation of existing and future utilities.
