A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
URGING THE MIAMI-DADE COUNTY BOARD OF COUNTY COMMISSIONERS TO
REFORM ITS EXISTING REGULATIONS UNDER CHAPTER 17 OF THE CODE OF
MIAMI-DADE COUNTY, FLORIDA ("COUNTY CODE"), TO ALLOW THE CITY OF
MIAMI TO ENFORCE THE MINIMUM HOUSING STANDARDS ESTABLISHED BY
MIAMI-DADE COUNTY; DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF
THIS RESOLUTION WITH THE PROPOSED REVISIONS TO CHAPTER 17 OF THE
COUNTY CODE TO ALLOW SUCH ENFORCEMENT BY THE CITY OF MIAMI
ALONG WITH THE ATTACHED PICTURES, ATTACHED AND INCORPORATED AS
"EXHIBIT A", TO THE OFFICIALS AS STATED HEREIN.
WHEREAS, Chapter 17 of the Miami -Dade County Code provides for the requirements of the
Minimum Housing Standard ("MHS") for incorporated and unincorporated parts of Miami -Dade County
("County"); and
WHEREAS, Sections 17.1 through 17.70 of the County Code allow for enforcement of the MHS in
the City of Miami ("City") by the County; and
WHEREAS, the County has the sole authority, pursuant to Section 17-6(15.2), to appoint a
Municipal Housing Inspector and has failed to do so; and
WHEREAS, the City has the ability to enforce the MHS through its own police powers, but the
County has chosen to legislate such enforcement; and
WHEREAS, notwithstanding any part of Chapter 17 as it relates to the City and/or the County,
should the County choose not to use its power to enforce the MHS in the City, the City should be
authorized to do so; and
WHEREAS, the City is currently without authority to enforce the MHS and is urging the County to
grant the City the authority to enforce the MHS within the City, and has enclosed a proposed
ordinance revision to effectuate such a change;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as fully set forth in this Section.
Section 2. The Miami City Commission urges the Miami -Dade County Board of County
Commissioners ("Board") to amend its regulations under Chapter 17 of the County Code, that sets
forth the requirements and enforcement of the MHS, and allows the City to enforce the MHS within

the City.
Section 3. The City Commission further directs the City Clerk to transmit a copy of this Resolution
along with the proposed ordinance change to Chapter 17 of the County Code and the attached
pictures, attached and incorporated as "Exhibit A", to County Mayor Carlos Gimenez and the Board.
Section 4. This Resolution shall become effective upon its adoption and signature of the Mayor.

Footnotes:
{1} This Resolution shall become effective as specified herein unless vetoed by the Mayor within ten
(10) days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission or upon the effective
date stated herein, whichever is later.
