HomeMy WebLinkAboutR-15-0006City of Miami Legislation Resolution: R-15-0006 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14-01206 Final Action Date: 1/8/2015 A RESOLUTION OF THE MIAMI CITY COMMISSION RESCINDING RESOLUTION NO. 90-546, ADOPTED JULY 12 , 1990, IN ITS ENTIRETY, AND DIRECTING THAT VEHICULAR ACCESS BE RESTORED TO NORTHWEST 23RD STREET, NORTHWEST 24TH STREET, NORTHWEST 26TH STREET, NORTHWEST 27TH STREET, AND NORTHWEST 28TH STREET, AT THE EASTERLY SIDE OF THEIR INTERSECTIONS WITH NORTHWEST 6TH AVENUE, AND NORTHWEST 5TH AVENUE, AT THE NORTHERLY SIDE OF ITS INTERSECTION WITH NORTHWEST 22ND STREET, MIAMI, FLORIDA; SUBJECT TO CERTAIN CONDITIONS AS MORE PARTICULARLY SET FORTH HEREIN; AUTHORIZING THE DONATION OF THE BARRICADE REMOVED AT SAID LOCATION(S) TO THE WYNWOOD BUSINESS IMPROVEMENT DISTRICT; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, RELATED TO SAID DONATION; DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE HEREIN DESIGNATED AGENCIES. WHEREAS, on June 7, 1990, the City Commission passed Resolution No. 90-431, adopting the Wynwood Safe Neighborhood Improvement District Plan ("Plan"); and WHEREAS, in response to the recommendations contained in said Plan, the City Commission adopted Resolution No. 90-546 on July 12, 1990, that authorized the permanent prohibition of vehicular access to certain streets within the Wynwood Safe Neighborhood Improvement District; and WHEREAS, out of the six (6) authorized locations, only one (1) barricade was installed to prohibit vehicular access to Northwest 5th Avenue, at the northerly side of its intersection with Northwest 22nd Street, Miami, Florida; and WHEREAS, the City Commission finds that the removal of the existing barricade and the restoration of vehicular access to the roadways in the Wynwood Safe Neighborhood Improvement District, is in the best interest of the public; and WHEREAS, the Wynwood Business Improvement District ("Wynwood BID") has requested that the City of Miami donate the removed barricade for artistic purposes by the Wynwood BID; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Resolution No. 90-546, adopted July 12, 1990, is rescinded in its entirety. Section 3. It is hereby directed that vehicular access be restored to Northwest 23rd Street, Northwest 24th Street, Northwest 26th Street, Northwest 27th Street, and Northwest 28th Street, at the easterly side of their intersection with Northwest 6th Avenue, and Northwest 5th Avenue at the northerly side of its intersection with Northwest 22nd Street, Miami, Florida, subject to the following conditions: a) The existing barricade and curb across Northwest 5th Avenue, at the northerly side of its intersection with Northwest 22nd Street, shall be removed and the roadway pavement restored for vehicular traffic; and b) Restoration of the traffic regulatory signs and markings at the intersection of Northwest 5th Avenue and Northwest 22nd Street shall be subject to review and approval by the Miami -Dade County Public Works/Waste Management Department. Section 4. The City Commission authorizes the donation of the removed barricade to the Wynwood BID, to be utilized for artistic purposes, and further authorizes the City Manager {1} to negotiate and execute any necessary documents, in a form acceptable to the City Attorney, for said purposes. Section 5. The City Clerk is directed to transmit a copy of this Resolution to the Traffic and Transportation Section of the Miami -Dade County Public Works/Waste Management Department, and to the City of Miami Departments of Police, Solid Waste, and Fire -Rescue. Section 6.
